    After all that today - i came home only to find a letter - i mean a FINAL DECISION letter from them.

    YOUR COMPLAINT - which are my reasons for complaining

    CIRCUMSTANCES
    I applied for a cap 1 card by submitting a postal application in july 2001 and did not purchase PPI at the time - WRONG - i applied via the internet - i remember as i did it at work and said it would make a decision in the post.

    At the time PPI was added i was 23 living at home and would have informed us that you were then employed or we would not have proceeded with the sale of PPI. - is it me or does this statement makes no sense? they already new i was employed i had been since Feb 2001.

    Cap 1 sell ppi on a non advised basis - we do not provide advise. Our role is to introduce the features and benefits - CORRECT - what they may have done was introduced the product giving you between 1 -3 months free then telling you if u dont want it to cancel after that time - however have it now as its free and receive the benefits just in case - (thats y there is a clause in the terms which i have read states you can claim once you start paying your premiums)

    FINDINGS
    The are confident that the optional nature was clear when discussed during the telephone conversation - I dont remember that conversation they claim it was 2002.

    ppi has been displayed on all my statements that the policy was in force. they have kept me upto date and even sent me the policy wordings - if that was the case i would have kept this booklet / info in my insurance docs folder and its not in there - so never received. and they had no reasons to ask if i had anything in place.

    the requirement for understanding the policy lays with me and i should have been aware of what policys i had in place before purchasing it.

    CONCLUSION
    no miss sale they believe i wo uld be elegible to claim if any insure risks had occured - i tried and was told no after fining out about it 2010.

    and i have 6 months to contact the ombudsman if i am not happy.

    You could ask them for the telephone conversation where you accept the ppi, if they cannot provide this,then tell them you will go to FOS as you have it in writing from them there was a phone conversation, this will be a long time to wait but if you win it will be worth it.
    If they do give you the recording, then you know not to take this any further if it proves you said yes,as the FOS will back Cap One.

    Sorry to hear this Rae.

    But as amersall says, its will be a good idea to request a copy of the telephone conversations, if they have proof then they should be able to provide them, it would make you think otherwise wouldn't it?;)

  • Anynews on a refund from Opus Cards. I have written to them and still nothing back. Looks like I will have to follow it up with one of my 'firm but direct letters'. As far as I am concerned they took over my account from Citi cards and now they need to be responsible for the PPI
