    After midnight. The full policy is published on the VM website.

    why am i being throttled at this time of night,
    More than likely because you have breached the download cap that applies between 9am - 3pm, and is then in force again from 4pm to 9pm.
    whats the best time to download on virgin media.
    Outside of the hours where the capping applies is probably a good start.

    @KillerWatt

    That's what's known as STM (Standard Traffic Management) and varies by product but there is also a shaping policy across all the VM broadband products that runs from 5pm - midnight and throttles back P2P and NNTP unless you hide it away from their shaping kit.

    An STM'd 10Mbps connection would still run at 2.5Mbps.

    Possibly its a low seeded torrent, torrents are hit or miss depending on how many folk are sharing and what there bandwidth are

    Maybe but you'd need to wait til the shaping is turned off to know because there have been many moaning about how drastic the speed reductions are.

    There are a few simple ways around it of course - research how to hide torrents and nntp, use http or FTP downloads instead, or most drastic of all I suppose - buy legitimate material.
