Ring repair help

I would bump my old thread (in which no one was able to help) but can't find it so a new one - hopefully some different people will see and perhaps be able to help out
Very briefly:
1) Had a ring resized at H Samuel
2) Unhappy with quality of work
3) Fobbed off repeatedly by lying (definately lying) store manager
4) Told store manager I wanted to get ring independantly assessed
5) Told by store manager that if I wanted to take ring I had to pay for the work done
6) Told by store manager that by paying for the repair I was accepting that I was happy with the standard of work, full and final settlement and that I could take the matter no further.
Is this correct? I was effectively forced to pay to get the ring back to have it looked at independantly and was most definately not happy with the quality of the work. I have attempted to take the matter further (particularly in view of the lying manager) but have recieved a stock response - you've paid, therefore tough luck.
Hopefully someone can give me some pointers here. At the moment I can't get to CAB, they keep strange hours.
Thanks all.

Have you had the ring independently assessed ....what did that say ?
If the work is confirmed as sub-standard, you could have it repaired elsewhere and then pursue H Samuel through the Small Claims court for the cost. No automatic guarantee of success though .... it would all hinge on the assessment.0 -
Yes, have had the ring looked at by a working jewellers.
To add to the first post, we had the ring resized smaller - when it returned there was a lot of platinum missing from the shank which now featured a completely different profile - pinched considerably at the bottom. Having done some research (I wish I'd known all this when we picked the ring up originally, I would have ripped her to bits in the shop - but I didn't know and was thus unable to argue my corner effectively, hence the request for independant assessment) this would appear to be from where they have cut the shank, filed off some platinum, soldered back together and then polished out the join. All fine in principle - the issue is the amount of polishing out they did, a considerable amount of material has been removed, the shank altered considerably and not particularly neatly and to be honest you can still see the join.
Manager claimed repeatedly (after apparently speaking to their workshop) that no platinum had been removed from the ring as it had never been cut. Apparently it had been resized by some mysterious means that she was unable to explain - the closest technique to this would be compression but thats not physically possible with this manner of ring with a stone set in the internal shank and a ruddy great diamond on the top. Compression is only for plain bands, ergo she was talking out of her a**e and continually claiming that my wife and I were mistaken.
The working jewellers who assessed the ring said the quality of the repair wasn't very good and he would not have been happy had one of his staff repaired a ring in such a fashion. He also confirmed the ring had been cut to re-size and that an abnormally large amount of material had been polished away.
I want to push this as far as I can. I'm angry that they made a mess of my wifes engagement ring, I'm so angry that the manager repeatedly lied to me - but at the moment I'm hitting the brick wall of this 'full and final settlement' stuff. So until I know if the manager was correct and that by paying to get the ring back I was forfeiting all right to complain further then I don't see how I can progress things.0 -
You need to have the ring assessed not looked at, another jeweller saying the work is not very good isn't the same as a written report.0

Agreed, a written report is required - however theres no point in me going to the trouble of getting a written report on the state of the repair until I'm sure that the whole shindig won't be knocked off course by the fact that I paid for the repair.
This is why I'm asking if the managers advice was correct - by paying for the repair did I forfeit the right to complain further?
This is the main point I could do with help on. If it turns out she was proveably in the wrong, ie there is a snippet of consumer law or whatever out there that says I can't simply be fobbed off with the fact that I paid for the ring ergo I have no recourse, then I'll pursue this matter to the end of the earth. If it turns out she was correct then I shall have to just be bitter until the end of my days instead.0 -
Hey hey, well done :T All my searches came up blank for some reason.0 -
Forget what the manager said ..... They may mean that you have exhausted their own complaints procedure .... but that doesn't mean you can't take action.
Get a proper report and require H Samuel to correct things within "x" days ..... then commence proceedings.0 -
If what the manager says is true you would probably have a case under Unfair Terms Acts since they basically held your ring to randsome and didn't allow you to inspect it.
But personally I think he's talking out of his _______!0
