H Samuel - repairs policy - help!

Very quick question, I'll return and give more detail when I can - had a ring repaired by H Samuel, not happy in any way with the repair.

Essentially we had to pay to get the ring back so that we could take it to be independantly assessed - informed by store manager that by paying for the repair in any way (after days of getting nowhere and a month without the ring we accepted a 25% discount on the repair cost) we were agreeing that we were happy with the repair and that it was essentially 'full and final settlement' and the matter was now closed.

I just wanted to know if this was correct advice - by paying a discounted price and taking the ring away do we have no more recourse for complaint with H Samuel?

    I don't know the answer to your question but I thought at the very least I should say something. I'm trying out this new thing you see - empathy. The doctors at the clinic recommended I give it a try; it might help with some of my problems (voices, urges, etc.)

    Well if you can't help, what do your other personalities have to say on the matter? Are they aware of any snippet of retail law that may be of assistance?

    I mean, this level of customer service is disgusting, especially as my mums in a wheelchair an' everything.

    I don't know if this relates in any way...

    but I once read a post about somebody being chased by debt collectors for a fine of some sort which they didn't agree with. They sent a cheque for a lower sum stating this will be a full and final settlement for the debt. The collectors cashed the cheque and continued chasing for the rest when it turns out his words 'full and final settlement' carried no weight at all and did not form a contract!

    I imagine its the same situation here.. if it is not and it transpires you have formed a contract then maybe it will be covered under the Unfair Contract Terms Act as you had no choice but to agree since they wouldn't allow you to have it independently inspected....

    Just my thoughts anyway, so be nice if I have it wrong! :)


    But you posted at 10AM and hadn't had a reply by 1PM where most people would be in bed or at work so maybe -- play nicely ;)

    I think that you've been held to ransom effectively. To have any hope of reclaiming your ring you had to agree to their terms. This strikes me as unfair and worth pursuing if that is indeed what you'd like to do.

    As an aside, it's clear why you have so few replies to your post. If you'd mentioned that you'd bought the ring for your girlfriend whose dying wish is to marry you, then we'd have been falling over ourselves to respond. You've got to get that human touch going, you know? Get the sympathy vote. If you've got a few disabled relatives or choking children then all the better! Mention them too!
