    lol.. I deleted it within 10 seoncds... not fast enough huh..lol.. I'd thought there was reference to 'few days' then checked and there didn't seem to be so I withdrew it as it may be unduly vindictive to ATOS..lol.

    I'm trying to smile about the whole farce, this afternoon, but I'm still sure the DWP should be paying me at the previously agreed WRAG rate of ESA, and not the 'Assessment Rate' if said Linking Rules apply.. :mad:
  • Hi Sim, glad it wasn't too bad. I'm still stressing now from things (which with hindsight) I did/said wrong last week.

    AFAIK even if the linking rules apply they are correct to only pay you the assessment rate of ESA until you 'pass' the medical, but if you score the points to be able to claim this time then the enhanced rate will be backdated to the first day of your claim this time rather than week 14 if it was treated as a new claim. does that make sense?

    I feel for you. I'm trying not to listen to my own thinking too much!

    Re Linking Rules, yes that does make sense. Thank You.

    I just keep wishing I'd given myself more time, to fully recover, last September after all the stress of the Appeal Hearing.

    There's no way I'm prepared to go through all that again.

    I'll send in the appeal form (as I'm expecting to 'fail' the medical today), which will then take months again to reach the hearing stage.

    Am going to concentrate on CBT / getting to AA / keeping sober and well, starting Permitted Work, and getting back into a routine in the meantime.

    Am I right in thinking that I'll be able to claim 'Assessment Rate' ESA, while I'm waiting on an appeal, as I did last year?
  • Yes you are right. They have to pay you the assessment rate whilst you appeal. I have been trying to put a little by each week to cover any gap between sending in the GL24 appeal form and the DWP re-instating the assessment rate.

    I know I should try to be positive about this but I like you feel that it is more likely that I will not score enough points. This is my first time going through all this so now understand what everyone is talking about regarding the assessments and how anything you say can be twisted to suit them.

    I'm expecting to get 'nil points', so anything else is a bonus!

    My appeal form is on it's way, so hopefully my claim will carry on as normal.

    Hi,

    This is something I'd be interested in hearing about.

    When I asked the Doctor, if I could see what she'd written, at the end of the Medical, she just said "I've just written what you've told me. You'll get a letter in a few days" :rotfl:

    Now, I can appreciate that they're wary of letting people see the report, due to the risk of an argument arising.

    However, if they've nothing to hide, and all has been clearly noted *as it was described* by the claimant / patient, then you'd think they'd be open about it all there and then.

    Was anyone on here, allowed to see their report at the Medical?

    Also, are the ATOS Doctors *pushed* into 'failing' claimants, by ATOS / DWP, or is the LIMA software that they use, engineered in such a way, that it prevents anyone 'scoring' any points?!
