Advice Please - In Redundancy Limbo

    I've had word that administrators have finally been appointed, those of us left are wanted in on Monday. Lets hope people start to get their letters next week then they can go about claiming redundancy etc.

    If you've been told information regarding a restructure or potential redundancy that in itself needs to be put into writing. Depending on the number of people involved (can't remember what the stages are), you need to give a timeframe for the consultation to take place.

    I do know what you mean about staying the course and tbh if you do leave it will be seen as either breach of contract or your taking voluntary redundancy if you take money from them. Either way, you may well put any JSA claim in jeopardy so you do need to stay and you do need to get something in writing, if only about the consultation process.

    In the meantime,I'd look for another job and start updating your Cv. It won't hurt and you may find something out there more suitable.

    There are well over 100 people involved, I don't know the exact amount though. There has been no consultation involved and it's been over a week since most people were told they were redundant and sent home.

    I'm wondering if we have a case for 'failure to consult'. Consultation should start at least 90 days before dismissals start according to government guidelines, we could possibly be due a protective award of upto 90 days pay through an employment tribunal. I phoned a solicitor this morning and was informed that if the company was no longer trading, this can be claimed directly from the government. Once we have redundancy confirmation in writing, we will need ET1 forms, which can be downloaded from the direct.gov.uk website, by searching 'employment tribunal claim form.' We have nothing to lose by trying!

    I will definately be staying the course, no matter how much I don't want to. Also I have been applying for jobs and registering with agencies and my cv was already updated ready. Hopefully I won't be out of work for too long.

    strange how jane norman etc have all had administrator orders placed on the london gazette website but hf, dol, kd are all not showing still?! im worried they have just BS'd us all and nothings actually happening!

    You are absolutely right, I was told on Friday that they had been appointed and yesterday when I arrived in work they still hadn't. Today again still nothing. It's the most ridiculous situation, nearly 2 weeks now and they're still not appointed. If it doesn't happen tomorrow they will need to re-apply through the courts.

    I hope you are watching the tv tonight though, there is a protest outside the Cornbrook building from 3.30pm and it should be on BBC News and Granada Reports. It has already been on both tv stations and various radio stations about it.

    how is this legal?! how are people
    meant to live when they arnt getting paid and cant get a new job as they are technically still employed?!

    how many times can they keep filing intentions to appoint administrators?! its a joke.

    No news again I'm afraid guys and as the courts close at 4pm, looks like the administrators are going to have to re-apply as the 10 working days limit has been reached. 2 weeks in limbo now, words actually fail me. :mad:

    I'm back with better news, we have been told that we're finally in administration. Administrators said the packs are ready to be posted, would likely be tomorrow when they go out now though. At least things can get moving at last though.

    About time!!!

    Probably be sent second class so will arrive Saturday morning which means it will still be next week before we can do anything constructive.

    Still at least you should find out what you are likely to receive for making yourself available which must be a relief
