Seller wont refund until royal mail refund

So I have been a bit sympathtic to my seller because I can understand why they won't refund.

However its very annoying waiting soooo long.

Item posted 13th 1st class recorded. Still not received. They won't refund until royal mail refunds them.

So of course its the usual 15 days until seller can claim with royal mail as that is when royal mail will look into it. They then said it usually takes 2 weeks for the claim, then they'd refund.

I can see why they are anxious to refund as they are saying its happened before, they refunded a buyer & then when they claimed royal mail said the buyer had received the parcel.

But surely the seller just like me can see with the tracking # that it just says its being processed. Doesn't say delivered, no signature so not like its even gone to another address etc etc.

I haven't done a paypal claim thingy cos I just feel paypal won't do anything as the seller is purely just following royal mail guidelines.

    No, Paypal will hold them responsible. You have plenty of time to open the dispute, but equally, this seller is seriously, seriously out of order on this one. Paypal won't give a hoot about the seller or RM guidelines if they can't prove delivery.

    It sounds like they are stringing you along until the deadline; RM claims can take a long time so I would think it's time to open a dispute.

    OP have you tried phoning your local delivery office, or popping in if it's easy to get to? Cards aren't always left to say something's been taked there as you were out.
    If no joy, then I would be opening a paypal case as it's not your problem how long it takes for the seller to receive their money back from RM, (2 weeks after making a claim sounds pretty quick to me, I was always under the impression it took an age).
  • I checked at my local delivery office end of last week as I have had it happen before re no cards left & parcels have been sat. But nothing.

    I also had another ebay recorded item arrive on Thurs 23rd. I thought it was this item I'm on about as had a card left, but upon collection it was another ebay item I'd bought Tues 21st. So that item 1st class recorded went through the system normally, but this one posted on the 13th, well no idea.

    I even tried at my village p.o just incase for some odd reason it was sat waiting, but again no.

    I'd open a paypal case now if you can. Sellers really need to know what their obligations are, he can't realistically expect you to wait weeks for a refund.

    What will paypal do, just find in my favour & refund?

    Or will they drag it out asking for proof etc etc & thus then wait anyway until royal mail claim.

    you will win and they will just refund you

    you will need to fill out a from from the Royal Mail to say you never got the item when they send it to you

    The seller would have to prove delivery, which he can't do as it's not been. As I said earlier I thought that it took much longer than two weeks for a RM claim, someone who's submitted a claim recently will probably be along soon to say how long it tends to take, I should have thought that a paypal claim will be easier & quicker.

    To be honest I don't think the seller is being unreasonable making you wait until Royal Mail refunds them for the lost parcel if they have proof of posting the item and supplied you with tracking information.

    By all means open a Paypal dispute/claim but the seller has proof of posting the item to you. The seller is not responsible for items lost in the post, it is Royal Mails responsibility to make sure the parcel gets to you.

    The seller can't make a claim until 15 working days have passed. If the item is still not delivered in this time then Royal Mail will send a cheque to the seller then the seller will refund you, they are quite quick at processing the claims but it does state that it can take up to 2 weeks (I think).

    I think you may find yourself in the minority with your view that the seller doesn't need to refund before RM pay out. Most of us on here are sellers, yet we understand that it is our responsibility to get the parcel to the buyer and if it fails to arrive we refund and then later we claim from RM.

    I would always let the seller have a bit of time, and of they are reasonable i may well wait well into the 2nd or even 3rd week, however if a refund was not forthcoming by the start of the third week I would be putting in a paypal claim. Unfortunately any form of claim opened against a selelr can cause the seller a problem, and should be avoided at all costs.
