item perfect when left but buyer says used?

I sold an item ( face cream ) beg of October. Item received by buyer and postive feedback left for me.

Today I get an email to say she has sold it on to a third party who has complained that it is not new and some has been used. I know that it left here 100% perfect. It was part of a set which I split so no box but it had a seal. She says she didnt open my packaging but just sold on recently.
Is there anything she can do - she is asking if we could come to an arrangement as it reflects badly on her business.

I think she may have looked at the ebay rules as in her email she says she bought it about a month ago but it actually was beg of Oct so I think she is out of time.

  • This reminds me of my perfume saga. I recently sold something I thought was sealed but wasn't 100% sure. I tried to make this clear in the listing, with the help of some people on this board. The buyer said it had gone off so I said I'd refund it if they sent it back. Then I got an email a few days later saying that they wanted to keep it after all and I got good feedback from them, which I did not expect. So happy ending - hope it works out for you too.

    you sold it to her in October and presummed she would use it NOt sell it on

    she wont have any comeback on you as 1 she is out of time and 2 she should have mentioned it to you when she bought it

    tell her to go forth and mulitply :D

    Tell her to sod off, quite a few people on ebay just expect people to bow down to their demands because they think they're scared of what might happen, when often there's no legal basis whatsoever!

    me and I will check it then. I was hoping maybe that i could get half
    of a refund or something. I have had to send them another one."

    I think they are being a bit cheeky really - any thoughts?

    I found it funny that she said it 'reflects badly on her business' - surely if she were that concerned, she would have checked any items before listing them to sell, let alone leaving you feedback?!?!?

    She's probably just poor at Christmas and is trying to get a pound or two in whatever way she can.

    Like the others say, nothing she can do or you should do, I would just pop her back an email politely stating that it left you in perfect condition and it would have been her responsibility to actually check any items she receives/sells.

    Yes, she is being totally cheeky!!! How dare she come back for a refund (even in part) after a couple of months?

    Another email is required I think, but I would keep it polite in case she decides to try her luck with an eBay dispute. She has not got a leg to stand on... it was her responsibility to check any items received and totally her responsibility to ensure goods sold as new, are!

    Ask her if she'd like your bank account details too, then she could just help herself (sorry, excuse sarcasm, but I get so wound up when people try it on).

    Don't forget to keep a copy of all your communications with her and if possible a copy of the original listing too (I know eBay clears them after a time).

    Anyway, good luck with this, I hope you can get her off your back soon.

    i agree with pennyuk, she has already left FB and is way to late to complain. send a email relaying that she should not send the item back and no refund can be offered , if i said I BOUGHT SOME TOOTHPASTE FROM ASDA AND GAVE IT TO MY GRAN , THEN 2 WEEKS LATER TOOK IT BACK TO ASDA AND COMPLAINED WHAT WOULD THEY SAY ? .
  • dont bother replying. They will take that as a weakness to push for more. Just give a short basic answer saying its too late. And ignore any more emails from her.

    If she has sent them another one how does she know it was the one she bought from you that was sent (& used) in the first place??
    Smile and be happy, things can usually get worse!
