Just to clarify, the questions quoted by skintandscared are for the old Incapacity Benefit PCA. They are no longer the same for the ESA WCA.

Thank you. I did suspect the form would have been changed by now - as I said this was in 2006. Many thanks.

driving = equals able to concentrate

    In the eyes of ATOS
To the driving all i said was "its ok"
friends- "i dont have any where i live now, but sometimes see my old friends when i visit family" I can see your point now thinking about it.

They have a weird way of working out if someone is fit for work.
Just sold a lawnmower on Ebay.. That's the last time my neighbour will wake me up on a Saturday morning!

Ah... these are definitely questions that can have indications for mental ill health effects. If you request a copy of the medical report it might be revealing. The feeling they're trying to catch you out is justified... in effect they often are. I'm tempted to say if they ask if you enjoy sex they aren't making a pass at you.. they're trying to find a way to fail you.

I understand the recluse... and the chatty nature etc when out.. and the unhelpful GP... it unfortunately is a real barrier to getting accurate understanding and help. When I go out... which I've managed 3 times since October and will do a 4th time to see GP next month... I am about as far from what people would expect as conceivable given the mental illnesses I'm diagnosed with. I've just got a psychiatric report that effectively confirms this... from the first medical professional who wasn't fooled by the illusion... although I did give him significant help to do his job. I too stopped taking my medication due to side effects and the GP wasn't interested... in fact later on at the end of the appointment he asked if I needed another prescription.

But what concerns me is you didn't realise you could appeal... possibly the DWP failed to send you the appropriate letter. Unfortunately there is a time limit to formally request appeal (although the actual appeal tribunal may take months or even over a year to occur).. probably a month... extended by 2 weeks I assume if you ask them for a statement of reasons for their decision. Outside of that time you'd need to make a strong case that you should be able to appeal... good excuse perhaps as to why you didn't in the time.

Otherwise you can apply again after 6 months I understand from the date of being turned down.
luckly they didnt ask me about sex..that would have been uncomfortable lol.

I had to tell the pharmacy not to keep giving me them. My neighbour would go and get mine on her way into town and they kept giving her them. It was stupid, it took 3 months...

Its nice to hear someone understand about being chatty when out and the gp. They are all to keen to get us on meds rather than deal with it. My first pyschologist ,when i was 15,wasnt great not what youd call professional..

It was over a year ago. It was annoying and im now on job seekers. Sometimes i am tempted to curl up and not get up.

I find the downside to not being on meds though is im less outgoing, bit more paraniod. But being on them i was asleep half the time.

:) It might be worth considering re-applying. Same money.. there is the likely stress of the medical and the ESA50 form after a few months... but you'd otherwise lose nothing obvious. And if you were to succeed.. well... better.

  • hey, thanks for all the replies. Here I a at 5.20 am unable to sleep, once again, its beenlike this since atos failed medical. All appeal papers were posted recorded delivery yesterday, along with letter of support. your words have brought me some hope, its just having to go through all this with appeals, tribunals. Yes muttley the frog, my emotions could well be spent elsewhere. this worry with the esa is totally draining me, I cant be bothered fighting anymore. Iv paid into national insurance and tax in this country all my adult life, but when i need it , i cant get help. yet others can come to this country and successfully claim what weve paid into for years and we get nothing, im sick to bloody death of the lot....

Its curious that the OP can travel on aeroplanes and fill out surveys to earn cash , but, has 'issues' that disable them from doing any work!

I don't think it's that simple... either in terms of health effects or ESA. Everybody is capable of some sort of work... even those in a coma. I'm in Support Group but if Damien Hirst offered a few grand to come sit in my living room so he could create some 'artistic picture of decay and decomposition in suburbia' then there's no reason why it couldn't be done suffice to say he would be at serious risk of harm...lol
