    As amersall says, a SAR is data you can request for, they should send all they still hold on your account with a one off payment of £10 cheque or postal order, they have 40 calendar days to comply.

    If they don't provide the disc recording, then there should be written transcripts of all calls.

    I SAR'd Crap1 in Feb of this year, submitted the form as they sent me back a copy of my application signed, but nothing for signing for PPI. Flat out refused, wouldn’t entertain any of my letters so i have sent off a FOS complaint around a month ago, i know that if i get a refund it will be very low, to be honest i only did it because of the way they seem to refuse everyone.

    Citi / Opus, has your card moved over to OPUS now ? Opus are part of Bank of Scotland, Lloyds Group, so you would need to email them. However i haven’t had any response back when i did, and speaking to them, they won’t even pass you to the department as it’s a "3rd Party" that deals with the complaints, and they apparently don’t have telephones.... sigh

    They are legally obligated to comply tho , can they not be done for saying no ?

    I shall find out soon as starting the process to take them to court next week with the preliminary letter due to them not complying with data protection act, raising a default even though the debt was paid in time (debt consisted entirely of their illegal charges) which is libel and Financial detriment.

    QUICK UPDATE

    CAP 1 - settled and paid it towards caard - i also send their executive team a letter requesting all late payment fees and charges, over £12.00 i only had one and they also refunded that to the card. **CASE SETTLED**

    CITI/OPUS - no joy its beyond a joke they promise phone calls and you dont et them so i am waiting for the 20/9/11 which is when my 16 weeks finish to send docs to FOS. They do not acknowledge you letters nothing what they have now said is their 16 weeks begin when THEY acknowledge your complaint. ok so my complaint was sent in May and after numerous letters and telephone calls which included a 1 hour one where i decided not to come of the phone to them i finally had my ack 2 days later - so its 16 weeks from their ack of my complaint which was dated august they go by.

    i have gone direct to citi and spokent to their customer relations team, the manager i spoke to said off the record if she could take it back from opus and deal she would as it wasnt mself that added the ppi on and i should be getting a refund but its opus dealing and they may do things different. SO WATCH THIS SPACE - this was a 8.5K credit card card held from 2002-2009 with ppi added on in 2005.
