Hi all - just a quick update.
Ive called citi to query where the rest of my statementsw were as about 2 years have been missing - apparently my info is coming off their sysytem so the only have what was sent to me.
Re the other lady statement i received - she appoligised and asked me to discard as printing error.
i take it they will only reimburse me ppi for the info they currently hold and nothing else??
CAPITAL 1
Called them as i havent had an Acknowlegement letter nothing - they have not even cashed my cheque for the SAR.
Anyway i asked the handler what was happeneing bearing in mind this was dated 25/05/11.
She advised they received my correspondence 09.6.11 and worked on it on the 14.6.11 and no ppi refund is due. I asked her what date the letter was sent - so she put me on hold to find out.
She came back and advised as the above para and the team state no refund is due and dismissed the ppi reclaim - at that point she tried to point out about my outsta nding balance.
I then advised her i am aware of this, as well as the company thye have assinged to deal with the matter and they have been receiving their £27.50 payment every month. I have been a very long standing card holder and held my card since 2000, and this is the way they treat me when i could not make payment - they gave me a ccj. AT WHICH SHE APPOLOGISED FOR IT GOING DOWN THAT ROUTE.
Anyway i advised her with my ppi calim form i sent a SAR requeste- they have 40 days to get the info to and i should have had an ackof my ppi complaint which they have failed to - as i have nothing to lose as they have already issued me with a ccj - if things dont start moving i will be taking it further - AT WHICH SHE REPLIED SHE WILL INFORM THE TEAM.
She re-took all my details and advs someone would be in contact with me shortly.

So sorry to hear of your issues here.
If you still paying for the ppi then its worthless to you if you have a payment plan or as such on this, so realistically they should cancel immediately.
Sorry if have got the wrong end of the stick here, but on what grounds have they dismissed your reclaim?
And if you don't mind us asking, what were your reasons for being mis sold?
In regards of the SAR, as you are aware they do have 40 calendar days, if you do not receive this by that timescale, write to them again and threaten them with the Information Commissioners Office (ICO).

she didnt say - all she said was that the team had noted the screen saying ppi reviewed case dismissed no refund due.
i thought this had been cancelled previously and which my complaint in i assumed they would cancel it as i did state the policy was of no use to me- however she also advised it had not been cancelled - this was still active and even though they had the complaint - i would have had to call and cancel my self.
re the mis-selling - i believe this was mis -sold as to be honest - i had no idea what it was. it was not until i called a few months after i was made reduntant and was not working and wanted to reduce my payments from the £100+ per month.
When i made the call to cap 1 the guy on the other end told me not to worry as i had ppi on the account and gave me the number for st andrews to put a claim in.
However when i called st andrews the gut i spoke to there said yes not a problem re claiming as fully covered due to redundancy, the only thing they wanted which i did not have was the job seekers letter to confirm claimed jsa for them to pay out- as i didnt claim they couldnt pay out and the time period had already lapsed as if i remeber correcetly u had to do it within the first 4-6 weeks.

Just had to re-request my SAR from Capital One as they deny receiving it and say if you send it to their Trent House address noone will send it on. Spoke to ICO and they said that is a complete breach of internal proceedings but recommended I sent it again as I had no proof of postage or delivery. This time it was sent special delivery so let them try and deny recieving this one.

Cap 1- Case went to the FOS - they havent done anything yet however i did email the CEO saying at the time i ticked no to everything cash back and ppi. So why one year later when i was in the same job, my circumstances had not changed, why would i say yes to ppi in a telephone conversation. I requested the transcript of this phone call and as they were unable to provide they refunded all ppi premiums + interest.
CITI - ive had nothing but the run around from citi as no one wants to take ownership. I eventually found out RBS is responsible for them, so emailed the CEO of RBS to query why the run around and no acknoledgement in relation to my letters. They have now assisgned someone to handle my file and should be hearing something next week.

Did they debit the £10 from your account (if you paid by cheque)?
Keep an eye on your bank account, if it's debited then it would mean they have received it.
But otherwise yes resend it again and make sure they do not debit the amount twice, good luck.The one and only "Dizzy Di"

In fact when the second SAR request came back it even had the letter from the first one stamped as being received on the day after I sent it and marked received £10. When I queried this they told me it took 2 weeks for the department to forward it on and sent me a cheque to cover the extra payment they cashed. They are still refusing to give transcripts or call logs for any telephone calls so taking this to the ICO.
I am also giving them 10 days to remove the default from my account as they say they don't have a copy of the default letter they sent but I never received and just sent me a copy of their template letter. In the template it states customers have 10 days to pay all outstanding amounts even though the consumer credit act clearly states a minimum of 14 days and some sites say the notice of intent to raise a default should be sent 28 days before this. The default is therefore illegal and must be removed.

Already got the refund. Suprisingly this came quite quickly after they realised they had cashed two cheques from me. It took a while to convince them but once I read out two lines from my bank statement with cheque numbers it was escalated and dealt with quickly. Shame everything else to do with them is a complete shambles on their part.

A SAR is a request to the company requesting all data they hold on your accounts with them.
