Did you not see the size of the adloop, or be given any print areas? Generally on proofs an enlarged version is shown for clarity, but a version to scale should also be pictured.

I have to say though, as someone who was a designer in the printing industry, it used to drive me crackers when customers wanted masses of information on something that was only big enough to have a web address on. If you specified you wanted the name of the company on 7 times, did you not think that it would make the font very small?

Despite the above, you should have been told the font would be too small, and given more guidance.

Not the OP's call. If that is the case, the seller has a duty to point this out.

All contact made so far has been via email or telephone. I will contact them again to ask for a refund and inform them that we intend to pursue the matter. Is it adequate to send this via email or should it be recorded letter?

Send by both, just to be sure.

Obviously you stopped reading right before I put 'Despite the above, you should have been told the font would be too small, and given more guidance. ' :p
There's a storm coming, Mr Johnson. You and your friends better batten down the hatches, because when it hits, you're all gonna wonder how you ever thought you could live so large and leave so little for the rest of us.

Just to clarify a couple of things...

you didn't know what the printable area was ? as it seems strange they wouldn't have this information somewhere on their website.
the proof wasn't to scale? the proof should simply be a low-res version of the file being sent to print -- so you can visualise how it will look at the printed size.

Well I don't think I've seen a website that takes orders for adloops online, that doesn't specify the print area.

The printing industry is weird in that you generally put exactly what is ordered by the customer.

Indeed they might, but it still doesn't mean they can include something which would not comply with the Unfair Contract Terms Act 1977.
    Of course.

The company we used (not sure if I can mention name) was the most prominent on Ebay. Have checked all correspondence again and at no point before the sale were we told the printable area. When we questioned the company afterwards they said it mentions it somewhere on their website although the proof size/area sent to us was not the printable size/area... work that one out? We did not buy the loops through ebay, I have been over the site this morning and printed out all of the pages....no mention of printable area.

Whats their website and ebay auction ID?

The proof doesn't necessarily need to be the correct size, as long as the proportions of the image are correct & you know the size it will be printed at. That would be enough to give an accurate idea of what to expect.

Their ID is 'personaliseyour'. We saw the company advertised on ebay and tried to place an order in the normal way but as we had wanted 2 colours instead of the 1 as standard, we had to order over the phone and could not go through ebay. We had not seen their website until the problem arose and had no need to order through it as it was being dealt with ok via email and phone. Having looked on their website afterwards it does state the size which would have been all the info we needed to clearly see that the font would have been too small to read. On all correspondence that went between us, at no point was the size/area mentioned.Their ebay site still shows no size/area.

The annoying thing is during the first telephone conversations we had, we were told by one of the partners that they would be remade and be with us within 5 days.

We had already waited 25days for the delivery when they had quoted 5-7 at the time of order.

I posted a thread a few days ago regarding buying Adloops from a big ebay company called 'personalizeyour' which when delivered were a different size than the ones we had been shown the proof of making our company name and logo too small to read. The proof had no sizes on but we were assured by the design guy that the logo etc fitted ok

After complaining, they refuse to remake them and I have received an email today where they have stated 'Your assumption on the size was incorrect & with hindsight this should have been on the proof which we have pointed out to the manufacturer and since rectified - this doesn't warrant a full refund'

They then say that no further correspondence will be entered into.

I feel I have the right to have what I bought from the proof I agreed to, are this company allowed to do this. I am £162 out of pocket with a bag of Adloops that you have to squint to see. They say they made Adloops with 7 logos on which we wanted but the size of the Aloop is almost half the size of the proof we agreed to.
