    ok, I have just written this letter to the agent and solicitor, I have emailed a copy to both. I think this is the right thing to do, my partner wants me to give it one last shot too, hope you agree because it's a bit late now if not, if nothing else I feel better for making a decision.

    Dear Sales team,

    I am now at the point with the sale of my property where I am very ready to withdraw. I feel this has not only been a sale based on initial deceit but also an exercise in ridiculous delays and attempts to extract money from me for dubious insurance policies. My buyer lied to me to persuade me to accept a low offer, one which I had previously refused on two separate occasions.

    My position is this, either we exchange before the end of this week with a completion date set for very early January (which I would like in writing) or I will be completely withdrawing.

    Frankly if it weren’t for this Christmas break next week (and my partner, who is somewhat calmer than I am) I wouldn’t be giving this deadline now, I would simply withdraw, however, I realise I am unlikely to have any new viewers before January so it makes sense to allow the extra few days for exchange.

    If I do not get an answer from the buyer regarding the exchange this week there will be no further communication on this matter and I will certainly not be entertaining any complaints from the buyer regarding his fees.

    My next move will be market my house with a fresh agent on the very first available date in January. Although I do appreciate the time you have put in, this episode has left me slightly bitter and I feel as if I need a clean break to move on with. As such, I would like you to accept this as my two weeks notice of withdrawing my property from market.

    Don't mess around any more. If they want it then they pay for it "as is". If you don't have progress within a set period then put it back on the market.

    Fine letter to the estate agent but I would deal with the solicitors as well. Instruct your solicitor to inform the buyer's solicitor that you require exchange of contracts by 21 December with completion by 10 January or you will be withdrawing from the sale and remarketing the property.

    As a sales progressor at an EA I would say:

    Put is straight back on the market with a different agent/privately.

    It is no good your agent speaking to the buyer; they should be speaking to the purchaser's solicitor to see what is outstanding and whether they are ready to exchange.

    If your purchaser's live next door, then there shouldn't be any ridiculous enquiries; this is time wasting and as they are still waiting for their MO suggest they are clutching at thin straws.

    Put it back on and tell them that you are happy to complete a.s.a.p.

    I don't rate your agents but writing to them isn't going to move things along quicker; action will....

    I have sent the letter to the solicitor as well. My agent said today that the buyers solicitor wouldn't speak to him under any circumstances.

    Floxie, thank you. That is really helpful indeed. In fact all of you guys have really sorted me out today, I feel much better now I have a clear direction and feel in control again. I will let you all know what happens.

    Hi Toto,

    I wish that you were one of my clients; I would have tried to help a long time before this...especially when the mortgage came to light. ....

    Take control of the situation; you don't need any p**ing about. This is a business transaction and you need the most out of it - no cash, no cheap sale.
    How about increasing your sale price (just before you exhange) for delays sake?

    And I wish you were my agent floxxie! You're not in Hertfordshire by chance are you :D seeing as I am looking for a new agent. I did mention raising my price to cover my costs due to the delays, that's when my agent talked about the buyer wanting his costs covered if I pull out!

    My answer to that wouldn't get past the language filter on this forum, but I think it's safe to say the agent won't mention it again in a hurry.

    Ever so similar whith whats happened to me I think. Ive considered pulling out but Im going to give it one more go with this guy and see what is going on.

    Do you think your guy is dragging it out so as he wont have to stump a void over Xmas? I think thats what we are having.

    It will be a small pleasure for you that he will have to pay extensive fees to his sols for all those enquiries ands requests he put in. :)

    If your buyer is messing you around, beyond what you consider acceptable, then set a date at which point you will remarket the property and be open to further offers. The benefit is that you may find a new buyer without losing the current buyer. If your messer really wants the property there is no problem in him actually exchanging contracts before you find a new buyer. If he has no intention of proceeding this will flush him out. If you do get a new buyer, make clear that the existing buyer has 3 working days to exchange or they will be out of the picture.

    This way you are being open and honest with everyone. The existing buyer has to move one way or another and you are not wasting time on a messer!
