Has your girlfriend read through her contract to see what she has agreed?
Most breast enlargement contracts have clauses for when things go wrong. I know my sisters says that if something goes wrong which is their fault, they will fix it for free, providing my sister allows them to fix their mistakes. They will not pay for someone else to the do the surgery, and if my sister pays for someone else to do corrective surgery, the original places' liability ends.
It might be worth reading to see if your girlfriends is the same, and deciding what solution you want. Did the person who diagnosed the CC say how it needed to be fixed - some cases mean the implant needs to be removed and placed in the other position (so if your girlfriends were under the muscle, it might need to be placed over, or vice versa). Finally, are you happy for them to conduct the operation, or do you want to find a new surgeon yourself, if your contract allows this?
Then I'd contact a solicitor as Flyboy says, and discuss everything to see if you've got a case. I hope it's all sorted for you soon - where did your girlfriend have the operation? I'd love to know so I can tell friends to avoid it - the aftercare sounds shocking!0 -

A well known and often espoused tenet of consumer and contract law is that if the original seller will not remedy a fault, which they have caused, the consumer may be able get someone else to and pass that cost onto the seller. There is no difference here.

Thanks for your replies, gf is out at her mums this evening so will ask her to check her contract when she gets home. She had the surgery done at Elyzea in Belgium, had the consultations and (supposed) after care :mad: in London, we was not sure if any British law covered surgery abroad? or might the fact she had it arranged here mean we can take legal precedings if needed?
The consultant lady we saw 4 weeks ago, who seemed lovely and helpful, explained it better to us, and gf originally had 'unders' (under the muscle) but the lady said because my gf is very toned, 'overs' should of been done as at present, my gf pec muscle is basically 'squashing' the implants almost flat, the female consultant was horrified at what had been done. This clearly didnt do gf's confidence any good at all, and we have had a few tearful evenings since
I will start penning a letter, may even post it on here if you guys (and girls) dont mind? Like to get it spot on if she is to take legal action
Still no call yesterday, or today, gf phoned ack, explained she is in pain and concerned, receptionist was no use whatsoever and fobbed her off again. To make matters worse, the clinic apparently closes down now for 3 or 4 weeks? Not too sure how true this is, something to them not doing surgical procedures during summer as more susceptical to infection? tbh I dont know what to believe from them anymore..............

If you are not happy with the breast augmentation surgery then you have various corrective surgical procedures which you can opt for. So, I suggest look for a professional in the field of plastic surgery online and get the desired results in the future.0

We visited a (supposedly) respectable clinic, with good reviews and feedback online, my gf had a bad consultation, poor advice and the aftercare for her was non existent. I have no idea why she was treated this way, had I of know, please believe me I wouldnt of dreamt of letting her choose that clinic. Your reply sounds as though she opted for some backstreet cowboy, she didnt. This is causing her a great deal of stress and pain, so please understand a little like most posters on here have0 -
I am sure that in order to save few dollars you have opted for a local surgeon to get the implants done. When it comes to giving your life to someone to play with, you should get consulted from a skilled surgeon to help you get the best results and avoid disappointment in the final stage.0

This is a difficult one, because it was done abroad, and I'm not sure if it will be covered under English law. I'm 85% sure it would come under Belgian law, so you might need to get legal advice should it come to that.
One important thing to bear in mind is whether your girlfriend was offered overs or unders, and if she made the decision or if the surgeon did. Going for unders is an odd decision if your girlfriend is very toned...they are more difficult, take longer to heal and it is much easier to get the size wrong. The muscle needs to 'settle' back over the implant, which is why it takes longer.
Is it the same on both sides, or just one? (Sorry if you've already said that, brain like a sieve at times). If it is just one, it is possible that your girlfriends muscles look a lot looser then they are. You'll need to find out if there was a reason she didn't have overs. The most common reason for this is that there is not enough breast tissue to accommodate the over - is this the case here? If it is, then your girlfriend will have to stay with unders, as an over physically wouldn't fit, and the skin stretches over the implant, leaving stretch marks and a very clear outline around the implant. So then you'd need to look into reconstructive measures - for slipped implants, for example, extra stitching can hold them in place.
It is very complicated, but I'll try and help some more if you can provide some extra info, I learnt alot working at a plastic surgeons! It's more complicated because of the differing laws.
If you look at your contract, usually it states that it is governed by British law (I think) does your state this?
(As an aside - how unhappy is she? Is it just that it isn't as she expected, or is it visibly incorrect, and completely unliveablewith? If she had the option of no implants or her current ones, what would she choose?)0
