My ex came back on Monday, and obviously couldnt get into the flat (keys changed), so he came to my place and l told him l have sold all his stuff to recover my money and that l thought he was not coming back. He seemed to take it well and left. The following day he phoned and told me he has decided to report my cousin to the police, flat owner. Mutual friends say he was told that a case of theft can not be made because reasonable attempts were made to get in touch with him and he chose not to respond, or let anyone know if he would be back and when, not in the public interest. He was advised to file a civil case, lm not sure what that will be so l guess l will have to wait for the papers.
Im not proud of what l did, and will not advice anyone to do the same, but hey, sometimes a woman has to do what she has to do. Special thanks to Daisymay2008 for give me the facts, l guess you are a lawyer and Brit1234, l think you are police officer for bringing the balance in all this and letting me see all possibilities.
I have now finally let go, and lm moving foward with my life. To everyone there who is still letting their ex hang around, my advice is LET THEM GO,they will never change, its hard but its possible. The longer you keep it, the deeper the pain you will feel.LET THE FOLK GO.

When I started reading your post I was pleased for you that it was resolved. But then..
As for your advice - don't generalise. Some people change, some don't. Some learn from mistakes, some don't.
But yes, OK, glad you got it sorted even if you did act almost as bad as your ex by selling his stuff.0 -

To the OP:
You have committed theft. The Police can take some months to get round to investigating this so you're not home free for some time yet.
Your other thread started in June. Despite what your braindead clueless friends have said, you have not made enough effort to contact them and by refusing them the opportunity to collect their stuff, you have just added another nail to your coffin in this respect.
If you are lucky he will file a civil claim which he will win. If you're not, his report to the Police will be investigated and you will get a well deserved criminal record for theft you will have to disclose on all future job applications for the next several years.0 -
And for the record, re. the assumptions made in the first post, Daisymay 2008 is not a lawyer.0

After reading OPs other thread I can see OP merely followed the views of those that agreed with her instead of listening to legally qualified ppl.
Although I do also think OP is going to get away with it. In order for the council to prosecute for illegal eviction they need to know about it and I don't think the ex will realise he's been illegally evicted.
I have some ppl that owe me money. May have to pop round to see what I can pinch to satisfy the debt *rollseyes*
OP I can understand why you did it but it still doesn't justify it and listening only to those that agreed may (only may) come back to haunt you later. Being morally right is not the same as being legally right.Inside this body lays one of a skinny woman
but I can usually shut her up with chocolate!

Hopefully he will have someone that will tell him that instead of phoning the police on the cousin, he needs to phone the police on the OP. Leaving a flat for a week does not count as abandoning it and gives you no right to enter it, let alone go in it and remove items to sell them on.It's not easy having a good time. Even smiling makes my face ache.0

If the cousin posts tomorrow along the lines of
"I went away briefly and came back to fine my ex had been into my flat, evicted me, thrown out all my stuff and sold much of it"
the subsequent thread will make interesting reading.0 -
OP may have made a fatal error in posting the details of their actions, providing evidence to cousin, council, cousin's solicitor, police etc. etc..
OP : Don't bother deleting the stuff, MSE keeps old stuff & S35 of DPA 1998 requires release of info in connection with court proceedings (even if only "being considered " court proceedings..)
