Thank you for taking the time to contact me on the issue of car parking charges.
The situation is that owners of car parks are entitled to charge – and to levy penalties if people do not meet the charges. If people do not pay the penalty, then the parking company is entitled to seek recompense through the court. They are entirely legitimate in that respect – they are not forcing anybody to use their car park – and if an individual does use the car park, then they accede to those terms. If they fail to meet them then the penalty/fine/charge is applied.
A distinction between the legal definitions and common usage of the term does not make any difference to the fundamental point that there is a charging system in place in a car park where there previously wasn’t, that it has caused confusion and complaint, and that part of that is due to a lack of explanation about how the system they use works.

Dear Sir.
I recently came across your website and your post on your meeting with the MD of ParkingEye. I was quite concerned to see you refer to the charges made by this company as "fines". I am sure you are aware that only criminal courts can issue and enforce fines.
I would also assume you would know that an individual or private company can not impose fines or penalties. Any charge made by Parkingeye would be for a breach of contract. Under any breach they could only recover actual losses and not include any form of penalty. By you referring to these charges as fines endorses peoples belief that they are a legitimate action.
It is encouraging that you have looked into this problem, however it is disappointing that you have accepted from the outset that this is a legitimate business. Rather then investigate the legitimacy of this companies business practice. I could list many many questionable practices by this company and others. However I do not propose to take up too much of your time, although I do believe if you took the time to research this company, and the private parking companies as a whole you may well have a different opinion on their practices.
I was tempted to reply with this.

They do "FINE" people and many do pay them.
It is what it is perceived to be by the person receiving it that matters.
We may know it is a scam run by lowlife crooks, but every day thousands of people pay these things and rightly believe they have been fined.
The government gets their cut of the blood money in tax, DVLA earn millions in selling private data to the local conman and everyone involved in the scam is happy.
The law exists to prosecute these crooks and conmen but it is ignored.
Non violent Vigilantism needs to break out, volunteers who set up websites key-worded giving out alternative advice to the threats on the "fines", pre-printed letters of advice placed alongside fines on cars targeted by these crooks and above all name and shame.

OK, I've got a £70 charge from Parking Eye for overstaying by 30 minutes in Aldi's car park. Situation was that we had Granddaughter with us (3 years old) and she needed the loo for a poo...no toilets in Aldi so had to walk into town and were consequently over the 90 minutes 'allowed' in Aldi Car Park.
Have now had 3 threatening letters from PE, gradually getting more unpleasant. Has anyone here got any experience as to what they will actually do please? I'm an OAP and this is getting a bit scary.

What will almost certainly happen is they will send their letters and then maybe 1 or 2 from a debt collector/solicitor. Then they normally give in and go pester someone else.
Parking Eye, Aldi tickets crop up a lot. We have never seen one go beyond the usual letter threats.
I think you will find the advise you will receive is to ignore them.0 -
Well Euro Car-Parks think that they can fine you £50, I noticed it on one of the signs when I dropped in at a non-local branch of Sainsburys, the 3 hour parking signs say parking charge, but the signs over the "Blue Badge" bays says Fine

Sorry it's off-the topic of Parking Spy and idiot MPs, but I couldn't see anywhere else to put it (although I had an idea when driving back from a course today, how about a thread to post pictures of "dodgy" signs [ones which read Fines, Penalties etc])0
