Unless the bathroom has changed shape since you viewed the flat prior to signing your tenancy agreement, you signed up to maintain that bathroom in a tenant like manner, nooks and crannies and all. That is somewhat negligent of your previous landlord but irrelevent to your current situation.
Your previous post comes off very much as 'the builder told me there will be damp anyway so none of the mould is my fault' and in the event of a deposit dispute it is highly unlikely that this argument would be accepted by the arbitrator.0 -
Can someone please advise.
We signed a new 6 months Assured Shorthold Tenancy in February 2012. We have recently found out that the landlord (whos name is on our Tenancy) died in January 2012 (before we signed the agreement). We have not been informed of this through the Estate Agents and we are wondering if this tenancy is still legally valid and binding.
We are looking to move house and asked how we would go about giving notice. This is our 3rd 6 month tenancy agreement and thought that this is now a periodic tenancy but hav been informed this is not the case (very rudely can I add). We have been told we cannot give notice until the end of the 6 months.
Please can someone confirm if this tenancy is still valid with the deceased landlords name on?? We have seen a house we like and do not want to loose it without checking everything. If it is not legally binding, can we then give notice and still receive back the bond and month in advance rent back??0 -
Since you signed a new tenancy agreement for 6 months then you are bound by this contract.
A peridoic contract arises when you don't sign a new contract and you go onto a rolling contract, month by month. This is known as a periodic tenancy.
As regards the landlord.
Whose name and address details are on the tenancy agreement?
Who signed the tenancy agreement?
How do you know the landlord has died?0 -

The landlords name is on the agreement and the address of the Lettings Agent.
We did not know that he had passed away. We have had no communication from the LA informing us. We only found out yesterday when the LA said that he will speak with who is dealing with the house as the landlord passed away in January.0 -
