Cancel T-mobile contract due to business voicemail extra charge
Hi to everyone,
it's my first post on the forum and I hope someone can give me some help.
I'm on a 24months contract (20£ per month) with T-mobile which started last 15 September.
Checking the bills on my online account, I found out that in the last 7 months T-mobile added to my plan, without any notice or communication and without any request from me, "business voicemail extra", charging me other 1,28£ plus VAT per month.
So in the last 7months instead of paying 20£, I've been paying about 22£.
I called the customer service, and they actually agreed that the charge was a mistake, offering me to delete it from my plan and to refund me the amount of money they charged me unfairly in the last 7months.
But, because this is just the last of a many problems I had with T-mobile since I joined them (when I signed the contract nobody mentioned the fair use policy and I use internt massively; international calls banned by default for the first 3months unless paying a deposit of 100£, so I wasn't able to use the Europe calls booster I have in my plan for weeks; internet coverage pretty !!!! in my area, etc.) I want no refund but just to cancel my contract because this extra charge wasn't on the contract I signed.
Can I break my contract without paying any ETF because of this or not?
I think this extra charge is a breach of the terms and conditions and I should not be liable to pay any early termination fees. But maybe I'm wrong....

Voicemail - they are offering to correct the charges.
Not sure about why you can't use Europe calls booster - all you do is add it on your account as an additional booster - you can have multiple booster, just have to be prepaired to pay for the extra ones which are not part of the plan.

As their is no extra charge if its a mistake and refunded you have no grounds to cancel .

actually I haven't been refunded yet: the operator offered to delete the voicemail extra and give me back the money, I asked to speak with a manager/supervisor to see if it was possible to cancel the contract because of that extra charge, but the operator just told me it wasn't possible to speak with any manager. so the call ended with nothing. the voicemail extra is still on my plan and t-mobile is still charging me extra-contract I signed.
Now,in short, my question is: is this charge "materially adverse" and sufficient enough to break my contract without paying etf?
I know that if t-mobile changes, for example, the cost of text messages abroad or the monthly internet allowance (from 1GB to 500MB) by law I could break the contract without paying etf as "materially adverse".
Can my case be assimilated to these examples?
I'm not interested in any refund, I'd just like to cancel t-mobile contract because I'm really fed up.0 -

Generally speaking a mistake is not sufficient grounds to cancel a contract. As long as they will put it right. From what you say, they are willing to

This charge isn't materially adverse as it is a charge for an extra service above and beyond what they are contracted to provide you, that they apparently added in error. As long as T-Mobile are prepared to rectify this mistake, you have no grounds to cancel.0
