Orange - Unlimited Data reduced to 500mb

Hi all,

When I took out my last contract with Orange 14 months ago, it was with an unlimited data allowance. My understanding of unlimited here is as much data as I could consume, none of which is chargeable. I've regularly gone over 500mb month by month (streaming radio etc), and not once have I charged for additional usage, or indeed contacted re: fair usage. Until now...

I noticed a couple of days ago that for some reason, I was being charged for data usage. It looks any trace of data allowance against my contract was inexplicably removed, therefore I was incurring charges. I phoned yesterday (13.06.11), and the woman told me she was able to put me back on unlimited straight away.

I then checked again today only to find my allowance was only 500mb, and not unlimited as promised yesterday. The guy I spoke to earlier could not put me back on unlimited, and neither could retentions, through whom I went when taking out this contract.

The guy has now had to 'send an email' to the Archives team who apparently have access to all possible existing product available, to see if my unlimited data usage could be reapplied. To reiterate - he agreed that what I signed up to was 100% unlimited, no matter the usage, and that the 500mb deal I have been placed on would incur a 61p per day flat fee for any usage over 500mb.

Anyone had any similar experience? Surely this is a breach of contract on their part?

Unlimited data (or anything else) has never been unlimited. There's always been a fair use policy in the T&C's.

All they're doing now is enforcing the fup.

There is no unlimited plan they can put you on and never was.

Unlimited mobile internet - subject to fair usage.
Mobile internet is not to be used for other activities (e.g. using your handset as a modem, non-Orange internet based streaming services, voice or video over the internet, instant messaging, peer to peer file sharing). Should you exceed your fair usage limit or such use be detected, notice may be given and Network protection controls applied to ensure the quality and availability of our network to all customers. This may result in, at Orange's discretion, reduced speed of transmission, suspension of data browsing services and/or suspension of your account. For use in the UK only.
    ...
Fair usage policies - inclusive benefits are subject to Orange fair usage policies which vary from time to time:
    1. ...
    2. ...
    3. Unlimited mobile internet - 750MB per month
    4. ...
So, 'unlimited' was 750, not 500, and they didn't charge you for going over the limit.
