Easyjet Baggage Claim

Hi

Was wondering if anyone can help me with a query regarding my luggage. Easyjet lost my baggage on a holiday this summer and after a couple of months they have finally agreed to pay out however they say that their liabilty is limited to 1000 SDP's which is equivalent to £768. The problem is that i have lost nearly twice that.

Now to recieve this money i have to sign release forms, giving me no further comeback against them. I have heard that i should question this offer and they may come back with a better one however i don't want to do this and end up with nothing.

Also i did have travel insurance while i was away, but i never infromed them as i was under the impression that easyjet would cover my loss, even though i am not covered now can i still call them and claim off the insurance.

Any help would be appreciated.

    You need to make the claim within a certain period of time with your travel insurance, but it's probably worth a call to them to find out. Might be worth checking how much you are insured for on your travel policy as you'll likely find it's not very much and probably less than easyjet are offering.

    There will have been a limit of liability related to luggage within the T&C of your booking. These were put in place because in years gone by whenever a bag got lost they airlines always fell upon bad luck since it was claimed that every bag contained the Hope Damond, the original of the Mona Lisa and £1m in cash .. so the airlines had to do something.

    I've had a similar experience with a bag containing about £1500 of camera gear going missing between check-in at Malaga and the carousel at Gatwick. I collected a Property Irregularity Report from the attendant at the time and I claimed with my travel insurance - purchased through easyjet (Mondial) and they told me they weren't liable as I wasn't in charge of the baggage at all times. I then went back to gatwick who said that as it had been 35 days since the incident it was irretrievably lost and I should contact easyjet. After finding the right page on the website this automated reply followed:

    Dear Scott

    Thank you for choosing easyJet for your travel arrangements.

    We are sorry that you have experienced damage, a delay to or loss of your luggage, while travelling with us.

    Lost/Delayed Luggage – 0-5 days since loss/delay

    If it has been less than 5 days since your luggage was lost then please contact the handling agent at the airport at which you reported the loss. Please click here for the telephone numbers.

    Lost/Delayed Luggage – 5-35 days since loss/delay

    easyJet will continue to look for your bags up to 35 days after the date of loss. Should your luggage be located within this timescale, we will notify you and make arrangements with you for repatriation. Please note that should you submit your claim before 35 days have elapsed, it will not be settled until after we have carried out the full tracing process.

    Lost/Delayed Luggage – 35+ days since loss/delay

    If your bags have been missing for more than 35 days then you should write to us making a claim for the loss.

    To make a claim please send copies of your confirmation, baggage tags, an inventory of items lost, proof of purchase or ownership of items being claimed for, the flight date, time, number and departure and arrival airports together with the Property Irregularity Report you obtained from the airport. In addition, please provide your name, address and all contact telephone numbers.

    My claim was processed and they offered me about half the value, suggesting they take 10% off the value of each item for every year since its purchase, for wear and tear.

    I am working out what to do next. I've read about the 1000 SDP's, which they haven't mentioned in correspondence to me, and I too have to sign release forms for the value they are offering.

    My next step is to check with my home contents insurance, write a stiff letter of response to easyjet and perhaps seek legal advice. Someone has stolen my stuff and I cannot replace it for £750. This is not the end...

    Firstly, I am a tad confused as to why you are resurrecting a three year old thread? That notwithstanding, I was always under the impression that airlines only compensated X (a poor figure) per kilo for lost luggage.

    If you pack high value items in your hold luggage then you should not be surprised if either the airline or your own insurance fail to pay the full value in case of loss/damage.

    16.3 (c) our liability to you in respect of Baggage shall be limited to a maximum of 1,000 Special Drawing Rights per Passenger unless (i) a higher value is declared to us at check-in of the Baggage concerned and a supplementary sum paid if required by us, in which case our liability shall be limited to such higher declared value (subject to such higher sum being limited to the value of the Passenger's actual interest in delivery at destination or (ii) it is proved that the damage resulted from our act or omission or that of our servant or agent and was done with intent to cause damage or recklessly and with knowledge that damage would probably result, and in the case of such an act or omission by a servant or agent, it is also provided that they were acting within the scope of their employment.
    16.4. Special Drawing Rights shall be converted into the appropriate national currency as at the date of judgment or settlement.

    Basically if you dont tell them in advance and pay any premium you are not covered. This is almost the same as posting a letter/parcel in the UK.

    The problem here isn't with Easyjet's T&Cs. The max level of compensation (1,000 SDRs) is set by the Montreal Convention, not easyjet. At the moment that's just under £1000, but this changes day by day.

    As others have said, avoid carrying valuables in checked luggage. If you must do so you need to make sure it is properly insured (either by informing the airline or through your own travel insurance).

    This is no longer true. It used to be under the Warsaw Convention, but this has been superceded by the Montreal Convention which gives a max of 1000 SDR, not an amount per kilo.
