DLA should I ask for a review?

    can I ask how long you current award has to run??? or is it indefinite??

    If it doesn't have long to run i would, to be honest, be tempted to wait for the routine review. Alot of people are having to battle to get the awards they are eligible for at review and are ending up going to appeal. My sons award was cut drastically although it was increased a month before we were due to go to tribunal.

    However if your award is indefinite then it would definitely be worth you asking for a review.

    Could I also ask what would you need the extra money for? Is it because of the amount you are receiving is not covering the extra costs of the current disabilities?

    The only reason I ask, is I have to make a decision whether I want to reapply for another review.
    I had MRC + LRM (1999 - 2000)
    then HRC + LRM (2000 - 2002)
    then didn't re-apply for a review until 2010 because I just couldn't face filling out those forms.
    Re-applied 2010 and given LRM only.
    No change in any of my needs since 1999.

    I'm trying to justify to myself as to whether the extra money would actually be worthwhile having, considering my current needs and if I really need the extra. If I do, I have to go through filling out another of those forms which I hate with a vengeance.

    There is no such current understanding as indefinite.

    The word exists and goes all the way back to the original invalidity benefit award [ * ] and was a technical way to take out of the system of re-checking those who's health circumstances were not expected to change within three years, and so, unlike the rest of means tested benefit would not need to be re-tested every three years.

    [ * ] in those days sick notes called MED3's were issued with a maximum of three months renewable. The DHSS system as it then was became overwhelmed with the 13 week renewal and the word ' indefinite ' was invented with the introduction of the original IB50 Form to identify those who were not expected to improve their health within the 36 month period.

    It's still a guess which way the current government will go, or rather be allowed to go, with re-testing all people of working age [ PIP ] but clearly that is their stated intention.

    Ref your #1 post charmaine you should remember they can assess you down as well as up, putting your current award at risk.

    In #70 here, you said you would ring the DVLA tomorrow - did you check to make sure your covered, did the DVLA & your insurance company say you were safe to drive ?

    both my daughtesr have high rate DLA care and mobility and on both forms it clearly states INDEFINITE ... they are children, well now 19 and 17 , and are now both in the support group of ESA .

    Hopefully they will not be re-assessed but indefinite does not mean that they cannot be re-assessed for DLA, just that it is unlikely, in addition, the Government have said that all adults will be re-assessed for PIP if it replaces DLA.

    Middle care and low mobility is a good award and as a previous poster said, the DWP and the tribunal (if you end up there) can (and sometimes do) take away all or some of your existing award-so be very careful indeed when asking for your award to be increased. I would strongly urge you to get advice from a welfare rights centre or similar.

    Incidentally, you can get an indefinite award-but even an indefinite award can be reviewed at any time.
