It's clear that the OP knew full well what they were up to and would serve them right, if Santander restricted the use of the card, sent the money back to where it came from and then closed down the OP card for delibrate breach of the terms.

Unambiguous my backside, the OP knew full well what they were doing, either that or they don't understand simple English.

Actually, the terms do not end with restrict the card - it seems to me that they can only "restrict the use of the Card and the Account to the amount of your Credit Limit".

The more I read it, the more I see it that the only thing they wanted to really prevent is to be able to spend more in one go, than the credit limit.

As they forbid it, but clearly describe the consequence, they should not be allowed to "punish" the customer differently. The only catch is if they don't provide a service to return funds, then they may not be required to do so...
    Enjoy the silence...
  • I am in a similar situation (though reached via a different path). I have approx £2k in credit on my Barclaycard (a card I have used for around 10 years). I was investigating buying private hearing aids for myself, and in order to roadtest them had to pay up front, with option to be fully refunded if the aids were not suitable for me (which they turned out not to be). So I had to pay out the £2k initially (and paid off that debit, to ensure i didn't accumulate interest, via remortgaging), then when i returned the aids i was refunded the money to my credit card. I now have all this credit and would love to put it back in my current account where I could move it to my ISA. But no idea how to go about it. Can anyone help? Worst comes to the worst, i still plan to buy private hearing aids in 6-12 months when a newer more suitable model may be out, and so could keep the credit on my Barclaycard till then. Either that or treat myself to a once in a lifetime holiday! :-) Look forward to any suggestions or advice. My first time on the forum :-)

They don't use 'absolute' terminology though. Surely they should say will rather than may (restrict the use of the Card ...)?

That said, if you take the first sentence and, most importantly, the full stop at the end of it, then that says it all doesn't it? But using the above 'absolute' terminology the word 'must' should replace the word 'should' in that sentence.

I'd ring the bank & explain why you have ended up in credit. They may transfer it to your current account in the circumstances.

Just to add...you may not be covered for fraudulent use of the in-credit balance, meaning you'd have to stand it. £2K would be a heck of a loss for you I'd imagine!

have you tried asking them for a cheque instead of a bank transfer as I've had a cheque before with no fee, but that was some time ago.
  • Thank you CH27, I have been burying my head in the sand about it as I assumed I had no recourse, but I guess it's worth a try. I had asked the Hearing Aid providers to not refund my credit card, in fact they even promised to write me a cheque, but they just refunded my card without my knowledge. Gadnammit.

You could just pay for things with your credit card ...for example fuel and shopping and put the cash you would have used into an ISA slowly over a few months.
  • You are right, it certainly would YorkshireBoy! Not sure whether just to keep the credit on my card now as I don't want any trouble. Though surely being refunded for goods which were returned in accordance with the Hearing Aid company's own t&c's would be evidence I wasn't using my credit card fraudulently?
