Imo, rent is between landlord and tenant, and housing benefit is between tenant and council.
So, if tenant overpaid rent, landlord should refund her the surplus. And if council overpaid housing benefit, tenant should refund them the surplus.
Bottom line is housing benefits are none of landlord's business. He is only concerned with rent payment.0 -
It's not cheeky, I can understand how awkward the situation must be. However if you are not running a charity, then I think it disingenuous to present yourself as a good Samaritan.
The issue is unfortunate enough for you, but taking on DSS tenants comes with it's own set of risks - most notably in your case a blasting administrative organisation "the council" whos right hand and left hand are totally uncoordinated.

this depends on whether the rent was paid to the landlord directly or to the tenant, it is only recoverable from the cleint if they actually received it.0 -

Have you got references to support that?
HB is tenant's money. If council think that they have overpaid then they should seek repayment from tenant.
Of course, they know that landlord is a better target to recover the money so they try there luck...0
