Letting agent refusing to allow Periodic Tenancy

Statute gives you a periodic tenancy if you don't leave (voluntarily) at the end of your fixed term (Section 5, 1988 Housing Act).
To get the landlords details, request them in writing from the agent under section 1 of the 1985 Landlord & Tenant Act. If they fail to comply within 21 days it is a CRIMINAL offence with a fine of up to £2500.
If tenancy is periodic, either tenant can give notice to terminate the tenancy - even if the other disagrees. It is then up to the remaining tenant to negotiate terms to stay with the landlord/agent if he can.Life should be a little nuts; otherwise it's just a bunch of Thursdays strung together.0 -

It's a £60 fee for 6 months so £120 per year - £10 per month. You've got to ask yourself if it really is worth all the effort to protest against it?
Now that you've had your 'disagreement', you may feel the relationship has broken down with the agent. Given that they are buddies with the LL and have a chunk of other income riding on ongoing contracts you will probably not get any positive result from contacting the LL.
Reporting the agent to their association will only escalate hostilities - that may seem unfair but you need to live with the reality... a S21 (which does not require bad conduct on the part of the tenant) request to vacate may follow.
So, if you really want to stay, suck it up and pay the fees. If not, then move and report the agent. I don't see how you can have it both ways.:hello:0 -

I know... It just seems like a really !!!!!! way to do business, we've basically been bullied in to handing over this money and now we're the ones who are going to have our cards marked as 'problem tenants'.
The whole thing stinks to high heaven.
One last thing before I sign off. I forgot to mention earlier but in an email I had a few days back they stated part of the reason for this charge was to cover the 'considerable' cost of securing our deposit with the Dispute Service. More crap - I checked their website and there are repeated references to "this service if free to tenants". Aaaaand as best as I can figure out it costs them £14+VAT per deposit as a one-off charge.
I see another moving day in my near future.

The other option is to ask for a longer contract. 12 months? 2 years? Then you just pay the £60 fe but don't need to pay again in 6 months. But do you really want to commit yourself for that long?0

Can I just point out that you only have the word of the [STRIKE]spiv[/STRIKE] LA that he is 'best buddies' with the LL. If I was the LL and had him handling 15 properties for me I'd be pretty miffed with him for losing me a good tenant for the sake of an extra £60 for the agent!!If you feel my comments are helpful then I'd love it if you 'Thanked' me!0
