What are my rights - Faulty Bed?

Hi,

I bought a bed and matress on the 12/08/10 from matressnextday.com

We had lots of problems in relation to the wooden slats falling through every time you rolled over! This caused the matress to lose shape.

We called them up and they sent out a new set of wooden slats. We changed them over but still had the same problem.

They then sent someone out and he said there was a fault with this bed, and sent us a new bed and matress. That was around December time.

However over the last couple of weeks, weve started to have the same problem again where the slats keep falling through when you roll over and the matress is started to become mis-shaped.

Just wondering what our rights would be? Ideally we would prefer a refund so we can buy something else as we dont trust this bed too much now!

The bed was £149 and mattress was £144
This is their warranty page, but it dosent mention anything about refunds, just repairing and replacing.

    As the bed is now 10 months old, you would not be entitled to a full refund, a partial refund maybe.

    But as long as they replace or repair the product I think thats all they have to do, unless you can prove that the product is not fit for purpose, which may be hard to do.

    Any refund would only be on the bed and NOT the mattress.

    Its already been replaced once, along with the mattress because it became damaged.

    Spoke to them this morning, the bed has now been discontinued. There going to send someone out on the 18th to check the bed. Once its been checked she said we can discuss options available.

    As its no longer available, appears a refund might be on the cards.

    If you like the bed and the mattress, why not just screw the slats into place
    make the most of it, we are only here for the weekend.
    and we will never, ever return.

    i've had experiences with them, but got a full refund.

    i had ordered 2 of their Flex 1000 Mattresses which come rolled up their site description states
    The mattress measures in at 14cm in depth and will arrive vacuum-packed using a patented revolutionary technology for your convenience. The mattresses are shrunk to a much smaller size by compression which facilitates transportation and storage. We can guarantee that within a few minutes of unpacking, the mattress will fill out to its full and permanent size.

    but after 6 hours they only filled out to 9cm and the zipped cover s came away along this zip ( i suspect they were not flexible enough to stretch with the foam) after many email and a mention of SOGA they agreed to send out 2 new covers which arrived in a box, but looked like they were just thrown in the box without any care, but as soon as you tried to replace the covers the same thing the zip would not work, so contacted them and again after several emails they agreed to collect them and refund us as long as we could fold these up and cover them or the courier would not collect them. which was impossible, so after several more emails they told us the courier would collect them uncovered.

    They offered us credit to get a new bed and mattress.
    Our new bed was delivered yesterday and has already broken! They piece of wood that supports the slats has collapsed leaving nails poking out the side of the bed. 3 faulty beds in the space of 10 months.

    Well insist on a refund.

    Am I within my rights to insist on a refund, or can they turn around and say your only entitled to another replacement?

    Ideally id like to get a refund and go elsewhere.

    I dont want to have to start modifying the bed by screwing in the slats. Plus the mattress has become mis-shapen now from where its fallen down the gaps.

    Slats do move about if not secured, like the above poster said you could just screw them in place or put extra ones in-that will also make the bed more comfortable I've found.
    You might have some recourse with the mattress but if you like the bed why not stick with it by doing 15-30 mins of DIY.
