    Sorry guys should of made that but clear, at the time if posting I wanted to keep the dress so was going to go straight to feeback but after much um'in and ar'in I am not happy...

    It just annoys me, if it is used then list it as used but worn once or something, not new!

    Noticed their a relatively new seller with 6 feedback too...

    This ebay lark makes me nervous! :o

    Ok so got an email back, speedy reply thankfully. :)

    She insists the dress is NEW and has been hanging up in the wardrobe but I really doubt this, I can see marks/stains on the dress. I have took pictures and you can even see them on the photos and I don't have the best camera phone either! lol!

    They say they don't normally do refunds but if I am unhappy I can send the dress back for inspection? I am not quite getting this bit? If I send it back and she says oh I cannot see the stains, even though she can, doesn't that mean I don't have the dress nor my money back?!

    Hmm confused now!

    Open a dispute on Paypal, not ebay.

    To open a SNAD you must go to Paypal and find the transaction. Don't let it direct you back to EBay. There are some clear instructions on exactly how to do it, which I think soolin wrote. I will try and find them.

    You will have to wait for the seller to respond and then depending on what they say, the case may or may not need to be escalated. Paypal will then review and tell you to send the item back. You must send it back tracked, be aware that whilst first/second recorded will be cheap and cover you for loss with Royal Mail, it isn't reliable and you may well find it hasn't tracked to delivery. You will lose the dispute if it doesn't update online. Your safest bet would be Special Delivery but this starts at £5 and for a heavy dress may be expensive.

    Once the item has been sent and the tracking shows attempted delivery/delivery or refusal, you can add the details to the dispute with the tracking number and you will receive a full refund of your initial payment, including your postage - but the returns postage will be paid by you.

    Alternatively, you can send it back tracked now and allow the seller to refund, if they don't, then you still have 45 days from purchase date to open the dispute and retrospectively add the tracking.

    Right, I have opened up a dispute in Paypal, The seller says they are sure the dress left there's in perfect condition, despite saying through eBay emails that she will make sure everything she sells in future is thoroughly checked, this leads me to believe that she didn't check it thoroughly?

    I have said I have pictures off the marks/pull on the dress.

    I inspected the dress as soon as I got it so cannot see how this happened any other way?!

    They have refused a refund despite me saying I will send it back using special delivery. They have offered me a partial refund through eBay so I am waiting to hear back how this could be worked out.

    I really don't think the dress is new, if it was then why would it have stains on it?! I think maybe they've worn it once and assumed it would be in perfect conditio.

    There was no need to open a dispute at all. The seller had already agreed to refund. If, having got the dress back, they messed you about, you can open a dispute up to 45 days after purchase.

    Can I reiterate that you MUST send the item back tracked and don't use "recorded delivery" as this can be dodgy and it's quite often that things get delivered without being signed for etc. Use "registered delivery", it costs more but it will definitely be tracked.

    Also, DO NOT close the dispute until you definitely have the money refunded to your paypal account. You cannot reopen the dispute once closed and it has been known for a seller to promise a refund, get buyer to close their SNAD dispute and then not give a refund.
