    Hmm...strange. I'm not sure why the PPI team sent you the letter then.


    Was it the PPi team who sent you the acknowledgement letter too?
    Anything that I do say, is strictly my opinion :p

    My first letter came from Telford asking me for my ID check and to go to a branch to do it.
    Letter 2 was from them again to say in receipt of written request and fee, and also id received. in process of dealing with request but not their practise to supply standard document which would normally be received through normal course of business. The would include copy statements.
    In bold type at the bottom of the letter it say to please quote the reference when corresponding with the dept in regards to this matter.
    Then I received letter 3 yesterday(i think) again acknowledging receipt of payment and they would forward details as per my request as soon as possible. It was in this letter regards specifics of telephone conversations etc. This is the letter from the PPI team in Manchester.

    Morning all.
    I've had two letters from RBS in regards to my SAR letter.
    1. I am unable to provide a copy of the loan agreement for the account number and sort code xxxxxxxx/xxxxxx. I have enclosed a copy of the policy document relevant to your loan and duplicate statements for the appropriate loan account.
    For the DPA to apply information which is not stored electronically needs to be held in a certain structured format and be easily accesible. An example of this would be if information was filed in alphabetical order, referring to the name of the customer and then file itself was broken down into different topics. Information held in such a structured format is known as a Relevant Filing System.
    As part of your SAR, the CCA would not generally be held by the bank in a relevant filing system and as such would fall out of the scope of the Act - this would mean that you would not be entitiled to it under the DPA.
    I note that you have a loan with RBS which has PPI but for which the bank has been unable to locate the loan documentation and I therefore include a schedule at the foot of this letter showing the details of this. Loan A/c xxxxxxxx, sort code xxxxxx Loan amount £9000, start date 23/1/2001 Close date still active, Insurance Premium £2238

    Letter 2 was from RBS Card service to say that they had been passed details of my SAR but couldn't find any details of any account but if I could supply them with a credit card number, even though I gave them all my addresses, I've checked all my bank statement and nothing for the cc, so not sure where to go, although to be fair I think I last had it in 1998, so before anyone jumps on moaning about they can't be expected to keep it all, so not sure about this one.

    Can anyone assist on where to go next? I have some loan details now for 5 of 7 loans all with PPI totalling something like £7k(not interest). In the policy documentation it does say that one of the main exclusions was if you had 'a pre-existing condition' which I had.

    That doesnt mean it voids the cover in other areas. It's most common outcome is that it only voids illnesses related to that pre-existing condition.

    No it may not void the cover in other area's but I am being charged a full rate for full cover, but couldn't have claimed under sickness, which at the age I was at the time the only thing I ever got and caused me to be off work was due to my pre-existing condition, which is unfair in my and many other's opinions. Plus they didn't explain any of this to me when supplying the paperwork at the time, nor did they ask if I had any medical conditions that would have made me exempt from claiming in that circumstance.

    Can I ask if anyone knows why the bank wouldn't have a copy of an agreement of a loan that I am still paying, allbeit I seem to paying through a specialised department of the bank, but could the Branch still have paperwork or details of the accounts I had with them? I just find it hard to believe a bank wouldn't keep proper paperwork for current loans!

    They are not saying they dont have it. They are saying its not in a relevant filing system. That probably means its bulk filed at some branch in paper form.

    If you opened it in branch within the last 12 months the branch will probably have it.

    However the branch would usually be contacted by the SARs team requesting any relevant paperwork.

    Ok, thanks, I did receive two seperate letters over two days, one from the SAR team, and one from the Credit Card team, I'll give it a week or so just in case anything else comes in and work on PPI reclaim forms instead, ready to go.
