Statement of repayment of TC overpayment.

A relative is repaying a tax credit overpayment from the begining of tax credits (they thought they had got away with it), they ignored it for years and a DWP person (they think, they didnt or cant remember checking) came to their house out of the blue and they arranged to repay the money at £50pw direct debit, this happened @2 years ago and they have been repaying it ever since at this rate, they cant even remember how much the overpayment is just that it was thousands.

This bloke said it couldnt be deducted from their current tax credit claim as it had been transfered to another Dept, could it have gone from the DWP to a debt collecter agancy?

They have not in that time had any paperwork/statement about the the overpayment and they suspect it may be payed off, how can they get a statement for the DWP to show what they have payed etc?

They rang the helpline a few months ago and they said it had nothing to do with them and they needed to contact a diffrent dept, they have looked on line for the phone number for this dept. (and so have I but Im not sure what Im looking for, they have lost the number they were given which is typical of their disorganised lives :o) does anyone know who to contact and should they have been given statments to show the state of play?

    Is it a tax credit overpayment, as your post gives refers to the DWP?
    I doubt the DWP can fiddle about with an overpayment which belongs to HMRC.

    HMRC tax credits do have an overpayment dept if that's any help.

    If it is a tax credit overpayment, DWP would normally not be involved as it is not their debt.

    The only exception is that HMRC have recently piloted repaying a tax credit overpayment via deductions from DWP benefits, but the arrangements etc. would still be done with HMRC as the debt is theirs. DWP not visit someone over a tax credit overpayment.

    The reason the overpayment can't be collected from the ongoing tax credits claim is likely to be because the original tax credit claim ended for some reason and a new one was made at some point.

    Your relative needs to contact the payment helpline at HMRC on 0845 302 1429 and they can tell them how much is outstanding/has been repaid.

    Thats what they told me but they are confused about who called, I know nothing about tax credits apart from what I read here and even I was sure it HMRC that administers them.

    If it was HMRC that called and arranged the £50pw payment to clear the overpayment would they send periodical papaerwork to keep them updated on what they owe?

    The only thing they are sure of is the phone call they made earlier this year and that was to the number you quoted, they were given another phone number to ring but they lost it.

    They know how much has been repaid but cant remember the initial amount, they know how much because it has hurt them to lose the money where as the overpayment didnt matter to them at all :cool:

    If they ring back that number they will put them through to the correct person, but if it is basic info (e.g. amount outstanding) then they can give it.

    HMRC don't send out periodic updates on the amount outstanding or amount paid to date. I would suggest they contact HMRC find out the amount that was owed, number of payments made and keep track of it from now on.

    You would only get your annual review form through and it would state how much is still outstanding.

    Im not familiar with tax credit review forms but I have seen their renewal thats just been done and it dosnt mention the debt, it has theit details, their kids details, the amount they earned and what tax credits they have been awarded on a two page document with three sides printed, is that the document you mean?

    Yes that's the one.

    Do you think it could be a debt with the DWP rather than HMRC? Were they getting any other state help at the time? The only thing that springs to mind might be that when CTC first started there may have been an overlap with IS/JSA payments and that of CTC, and that might be why the DWP are claiming back the overpayment rather than HMRC.

    God it sounds confusing when you're not aware who the debt is owed to.

    It would only be on the forms if it was an overpayment from the current claim. The fact that it is being repaid directly (and confirmed by the OP saying the claimant was told they couldn't recover directly) indicates that it is not from their existing claim but from a previous tax credit claim.

    If it is, then there will be no recording of it on any forms, the current award notices will only show info relating to the current claim.
