Talktalk - automatic 1 year renewal!?

We have recently left talk talk. We waiting until our 2 year contract was up and then migrated to BT. We now have a £125 bill from talk talk as a termination fee. Talking to them, it appears that they will automatically put you onto a new 1 year contract if you do not tell them otherwise, within 14 days of the previous contract terminating. We are going to be cancelling out direct debit and have no intention of paying this but has anyone else faced this? We had no notification of this, we signed nothing and can find nothing about it in our original contract! It stinks of malpractice to me!

    Ok.... so I see that this is a somewhat normal procedure. I am well aware that this is the subject of an ofcom investigation so how likely are talk talk to chase this? We started out with Opal and I cannot find a copy of the original terms and conditions but I find it hard to believe that a court would agree with an automatic renewal when we specifically waited to ensure that we were not liable for a fee!

    If you cancel your DD then yes, TT will chase it, pass the debt to a DCA, and eventually trash your credit record.
    if you want to dispute it, you need to make a written complaint.
    No free lunch, and no free laptop ;)

    We have cancelled our DD and have written to talktalk requesting that they provide us some relevant information. We are unable to find the clause relating to this mess on our original sign up (with Opal) and we are unable to find any evidence that talktalk provided us with a copy of their terms and conditions when they took over the account. We have agreed to pay if they will provide this information proving that we are contractually obliged.

    They've never automatically put me on a new contract, I've had several 1 year/18 month contracts with them. When it expires I think you only have to give a month's notice. They've always phoned me when the contract has/is about to expire and offered a deal for signing up for another term, just got 6 months half price for a 12 month contract. You can even do it online (but the offer is rubbish).

    But I was originally with TT not one of the many companies they took over, so maybe there is something in your original contract?

    macman is spot on if you cancel the DD whilst trying to resolve this you could end up being chased by DCA.
