will i get my dla back

i was on hrm/lrc i have had 2 heart attacks /got crones disease / dementia / and mental health problems my support worker advised me to apply for hrc i got refused and told they believed i was on the correct rate i appealed and got an aots doctor to my home for a medical then i got a letter saying i have been taken off all dla. my cpn is doing me a letter to send them but i dont no if this will help as my consultant from the hospital already told them i need a lot of help as iam incontinent and dont go out the house without someone being with me as i would get lost i have appealed again but have not heard anything yet do i have a chance of winning my appeal thanks

    If you need someone with you because you get lost you should be eligible for LRM not HRM.

    Are you unable to self manage your continence issues?

    hi i have a drainage system that drains continually through the day and night i have fistulas i have no voluntarily control over my bowels i have breathing trouble due to angina and suffer from panic attacks i take 23 diffident tablets a day i have carers to come in and give me them due to my dementia

    In that case your CPN needs to get you additional help in dealing with your appeal, they need to do more than write you a letter. If they will not do it themselves, ask if they can put you in touch with DIAL or Welfare Rights.

    You say your DLA was remooved after an appeal and that you have appealed again.

    If this is the case then your second appeal, which would be to the Upper Tribunal, will only be heard if you can show, and it is accepted that there may have been, an error of law during the original tribunal.

    Are you sure this is the situation? It would be unusual for a claimant to appeal to the UT without assistance from an advisor experienced in this area.

    If someone that needs that much help but yet gets taken off Dla what hope is there for the rest of us the people in the DWP and Atos need yo sort themselves out if i was you i would fight fight fight for what you deserve this sort of thing should never happen good luck OP if I was you o would also take this to my MP god thinks like this make my blood boil

    hoperer is quite right that was what did happen i would have quite happily not bothered appealing for this reason but my support worker has the rights to all benefit decisions due to my Alzheimers

    yes she has the legal right to act for me if she never put in for hrc i would not be in this situation now i dont trust these people any more iam 42 years old i have enough going on with my health to worry about now i seem to be trying to sort this mess out to atleast its keeping my brain active

    She was trying to help you you would be the first to moan if you found out you could claim for something and she didn't apply for it she thought you were entitled to high rate care so she went for it its not her fault its those idiots at DWP and Atos you should be shouting at. You could also do it yourself you ungrateful so and so
