can I relist an item that hasn't been paid for?

I listed some items on ebay recently and someone bought 2 items and requested combined postage. This wasn't a problem so I sent an invoice with the revised total and a few days later the person responded saying they needed until Friday for money to clear in their paypal account so they could pay for the items.
My T&C for selling say payment must be within 3 days but this item ended on the 29 May but I let it slip and didn't mention it to the buyer as s/he indicated they would pay.
However the payment still hasn't materialised and I am now wondering if I can just cancel the sale and relist the items since there is free listing weekend on?

No don't relist the item as the buyer may pay and then you will be stuck. Open a none payment dispute now and wait 4 days, then close it. Ebay will give you back your fees and then you can safely relist the item.
Your terms and conditions mean nothing to ebay, you can write what ever you like but you need to follow ebay rules.0 -
Agree with above - if you don't follow procedure YOU will be punished by ebay if he pays and you cannot post the item.
Provided you don't put a buy it now - you can relist the item today for 10 days.
You can cancel the listing if they pay OR leave it to run if the case is closed without payment. You can even add a buy it now then.
You must remember though - and i'm sure many people will advise against this.0 -
Finished on the 29th so the buyer has had a week, I would drop a quick email to say if payment isn't received by the 7th June you will open up a non-payment dispute.0

The buyer's already had extra time, I would open a NPB case now.
I have a couple open at the moment, they can be closed Monday I think, but I'm going to relist tomorrow on a 10 day listing, hope that if anyone else is interested they will watch for a couple of days.0 -

I wouldn't wait any longer before opening the NPB. Even once it is opened the buyer still has 4 days to pay and that will automatically close the dispute, and i htink that is fine time wise.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. If your listing states payment within 3 days ebay will be on your side. however I would do the following.
You can wait until the person pays, I assume he/she hasnt payed friday 3rd. You have to wait for 4 days in ebay before you can issue a dispute.
I would inform the person that the deadline has expire and wait for their responce.
If the item is being intended to relisted as a auction for 10 days (not BIN) then you can start and it will run while the dispute is being finalised, or if the person pays you can cancel the relisted auction.
Only what I will do, but becarefull as if you sell more then the new buyer will not be happy if you cannot supply the demand0 -

Ebay don't care what a seller puts in their listing, the NPB cannot be opened until day 4. There is also no need to keep reminding non payers about deadlines, just open an nPB and close it 4 days later.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. Ebay won't give a toss what you put in your auctions about payment within 3 days, they make the rules.
You can't open a dispute until 4 days, so why put stupid terms in your listing?
Why would you now tell the person that they are late paying & give them even longer?0 -

There's no need to be so arsey. I have in my listing that payment is expected within 3 days, therefore if payment doesn't materialise within 3 days I can open an NPB dispute on day for. I don't really understand why you think these are 'stupid terms'?If you always do what you have always done, you will always get what you always got!0 -
You can't enforce it, so it's a waste of time, ebay allows 4 days for buyers to pay.0
