You can't receive CA if your income is more than a certain amount per week (currently £110 I believe) but as others above have posted, you can still claim and have underlying entitlement which may "be worth something" in certain instances. (I have underlying entitlement but it hasn't "been worth" anything except a free trip to the Zoo I'm afraid).

I really have tried to look for the answer but feeling a bit thick as I can't find it.. She is on £155'ish a week with no other income and I have put in a DLA claim and hoping for mddle rate care.

    Help would be appreciated.
no i dont think she can claim it. i think she will have an underlying entitlement to it but she wont be able to claim. Get down to your local citizens advice centre and ask or give the benefits enquiry team a ring on 0800 882 200 .

Thanks and I will make that call but only once (or should I say if:)) I get awarded DLA.

no, you cant get state pension and carers allowance. a friend of mine is long term carer for her adult daughter and carers allowance stopped the day she started getting her pension.

    Has she investigated this?

She can still claim for carers allowance (if you get more in pension than the carers allowance pays you wont get any money from the carers allowance) so because they wont 'pay twice' she would only get was is called 'underlying entitlement' - effectively you get the benefits of being in receipt of carers allowance without the actual money from the carers allowance being paid.
I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

Thanks for that and I must be thick (:o:o:o) as I am not entirely sure of the benefits of 'underlying entitlement'??? Apart from Strapped saying about free trip to the zoo what other entitlements will there be. I have just been Googling but no luck so far.

    Thanks Hoperer

Excellent advice & will soon (I hope) find out what my GP will, and will not, say. So could hinge on him being sympathetic but fair I guess.

Effectively you get carers allowance just without them paying you the money.

You still benefit from the extra premiums which are available for HB/IS/ESA etc
