bad holiday mastercard refusing to help

Hi All
we booked 1 week self catering in la rochelle france with a couple who live there and own this apartment. They describe it as relaxing, quiet, prestigious area.
we told them by email (cannot find the email to prove this) we needed a complete rest after both suffering serios illness in recent years.
because of building works going on at the apartments across the way it was just so noisy, we decided to cut our trip short and telephoned the owners.
They were so apologetic and said we knew it was going on and we will have to refund your money and reimburse any other extra costs incurred. when we got home they gave us £70 after we had paid them £455 for the week.
mastercard said they can only help where the retailer fails to provide the goods or services requested.
surely the fact that we said we needed a rest and they advertised it as relaxing and quiet is the failure to provide the service.

Quality of service is not covered under chargeback regulations, you did receive the service you paid for, (your acommodation) it's the quality of that service which you are disputing so they are right to reject your claim i'm afraid.0

I think if this was allowed a lot of people would be getting free holidays. Can you imagine the amount of people who would put in a claim if they thought they would get their money back by saying it was a crap holiday.0

I do have proof of the building works and noise having recorded some of it.
I think they are dishonest, if I had been told about the works I'd have cancelled, the owners knew it was happening and it had been going on before I made my final payment.:cool: Wisdom doesn't necessarily come with age.

just to let you know ECCS trading standards europe is looking into this, they may not be able to do anything but will let you know.
so there is somewhere you can contact should you have poor service or products from europe.:cool: Wisdom doesn't necessarily come with age.
