    Just a quick update - went to court, defendant didn't turn up and I won after talking to the judge for about 5 minutes. I didn't even get all the way through the story, he just said "Well I think I've heard enough, how much are you claiming?"

    I would encourage anyone to go to court via the small claims track where possible. It was not as intimidating as I thought it would be - you're just in a small room with a judge. Thanks for the help guys, otherwise I may never have gone.
    So you have the Judgement. Still doesn't mean you will get your money back.

    That's always the problem. it's up to you to collect the money if the defendant refuses. So how are you going to do this? Most methods will cost you more money.

    Winning at court still leaves you a long way short of getting your money. Before you decide how far to take it I suggest you investigate what happens after the court case if he still doesn't cough up. You could still have a long, expensive road ahead of you.

  • Yeah, he's been sent a CCJ - it's to him personally not his company. I think judging from his background (business owner, seems to be legit) he is the kind of person that would NOT want a CCJ affecting his credit rating so I'm hoping that he will pay, I think he can also afford it. I'm doing some reading on enforcing CCJs at the moment but I'll see where I am if he does not pay within 30 days.
