A used purchase is 'as is' anyway... the fact you have been honest in your advert about any work that had been done, offered the prospective buyer not only a chance to start it but ride it (and they declined)... means your absolutely fine.

Your correct, he has had the bike stripped by someone you do not know and has potentially caused further damage (without you knowing).

Stick to your guns saying you offered him the chance to not only start it but ride it (and was working fine up until now). You cannot be held responsible for something that happens after it has left your possession, they could of damaged it stopping it starting and try to blame that on you to get a refund!

Try get a print out of the advert you put on gumtree and keep it along with a copy of the receipt if you have it.

    Just to reiterate,
    Private sale means bye, bye.

Should have checked it out properly before he handed over the money.

Just ignore his texts, if he continues to harass i would report him to the local plod.

Private sales have always been buyer beware, though you do need to admit a car was clocked if you are aware, as a minimum you have to say treat the miles as incorrect.

There is a very good reason why dodgy traders pretend to be private sellers. Buyer beware, simples.

    Hi there,

Was looking for some advice...I sold my Offroad Dirtbike on Friday there and was advertised on the Gumtree website. I was completely honest about any work that had been done on the bike and had a few people come look at it, bike was starting and running fine. Got offered all the cash i wanted for it and the guy just had a quick look at the bike, offered him the chance to start it and have a shot on it before purchasing it but he said it was o.k.
Now few days later i recieved a text from him saying the bike isnt starting, the work he thinks was done to it (even thought i never said or stated anything in the advert what he is claiming was done)...he is saying it was miss advertised and is telling me he is bringing the bike back to me and wants a full refund.
To my knowledge, the bike was running fine as previous enquiries had taken the bike for a ride, started it up fine with no issues at all...and now this buyer is telling me the bike isnt running, his friend stripped the bike down, doing god knows what to it...and now as said earlier is demanding a full refund.
Just want to know where i stand in all of this...as i offered him the chance to start it and ride it (he never took this opportunity) he has now stripped the bike and claims stuff hasnt been done to it, when i never advertised all of the stuff had been done which he states i did.
I dont want take back a bike which has been stripped by no one i know, could've done even more damage to the bike for which i dont know...just want to know where i stand.

Sounds like he just wanted some free parts off your bike.
Probably took off what he needs and fitted duff parts off his own bike or his mates.:(

Cheers for the advice Adam, have still got the advert from gum tree as i saved it for offline use...i noticed that i had put at the bottom anyway ''SOLD AS SEEN''...not much cop but still it was there none the less...the bit i had put was piston ring replaced and flush of system...nothing stated here about new gaskets being used or replaced (cant cause the bike NOT to start anyway even if there werent any present, well perhaps a wee leak here and there but there are gaskets on the bike) and he is claiming the gaskets are all old and some missing....when blatantly i know they were all there)...seems like he's trying to threaten me in a round a bout way telling me he will be bringing the bike back tonight and to have the cash ready...dont know what to do about that situation either...these bikes are notrious for going wrong and constantly need worked on as they get bashed about offroad and to be fair, dont think the guy really understands how much work these bikes need done to them after every ride!

Stick to your guns, you have the advert, its a used sale for a used bike... sold as seen and was working fine when you sold it, the buyer was given the opportunity to start and ride it but chose not to... he cant run back and demand a refund now when it doesn't work! If he gets a bit threatening just report it with the police

Well the bike itself had alot of money spent on it myself when i first bought the bike, replacing reed valves with aftermarket superior ones costing me over £300 at the time...bike was worth £1300 and i sold it for £900 stating on the advert that plastics needed replaced, other bits needed done to the bike but the bike still started and ran fine, hence why i dropped the price as new plastics and levers, handlebar and kickstart lever would need replaced at some point as they were paint flaking off it and levers were damaged but still in working order which he knew about and saww on the day of sale as i re-iterated the fact to him plus i wanted the bike sold and had to drop the price due to other bikes in same category being the same price range so wanted to keep it in the competition for a quick sale...the guy got a bargain along with all my practice kit helmet, clothing, boots and goggles (all worth over £500 alone)!!!...if anything i feel like ive lost out but to hell with him...will just wait and see if he turns up or not

Sounds like the guy was very well informed of what had been done to the bike etc... and got a few things extra with it

I wouldnt back down, tell him to bog off
