Private Seller Query

Hi there,

Was looking for some advice...I sold my Offroad Dirtbike on Friday there and was advertised on the Gumtree website. I was completely honest about any work that had been done on the bike and had a few people come look at it, bike was starting and running fine. Got offered all the cash i wanted for it and the guy just had a quick look at the bike, offered him the chance to start it and have a shot on it before purchasing it but he said it was o.k.
Now few days later i recieved a text from him saying the bike isnt starting, the work he thinks was done to it (even thought i never said or stated anything in the advert what he is claiming was done)...he is saying it was miss advertised and is telling me he is bringing the bike back to me and wants a full refund.
To my knowledge, the bike was running fine as previous enquiries had taken the bike for a ride, started it up fine with no issues at all...and now this buyer is telling me the bike isnt running, his friend stripped the bike down, doing god knows what to it...and now as said earlier is demanding a full refund.
Just want to know where i stand in all of this...as i offered him the chance to start it and ride it (he never took this opportunity) he has now stripped the bike and claims stuff hasnt been done to it, when i never advertised all of the stuff had been done which he states i did.
I dont want take back a bike which has been stripped by no one i know, could've done even more damage to the bike for which i dont know...just want to know where i stand.

    Did you supply him with a reciept saying 'sold as seen'?

    Was it a private sale? is You're not a trader.

    It's a private sale, and you say the bike was accurately described, so the buyer has no right to any refund.

    You don't need to do anything. So long as you honestly answered any questions he asked, then you have no further obligation to the buyer.

    I did provide him with a receipt, hand written as im not a trade seller but a private seller...had the bike for a while and wanted to buy another bike...never wrote on the reciept sold as seen though :/ the bike was running fine the night before as the other guy who came and seen it had a run on it, the guy spent an hour checking over the bike etc...and said he'd get back to me the next day...but the guy who bough it spent 2 mins max...just looked at it from distance, didnt even start it or ride it...bewilders me really :/ if the bike hadnt of started or ran fine then, then i would've looked into it, but now after its been sold he's wanting a full refund, told me i better have the money ready for him as he's coming with the bike tonight after his work. Dont have a clue what to do...i thought i was well within my rights as a private seller...as goods are sold as seen. nothing was stated about most of the things he's claiming i had advertised was changed...so still bewildered as to how he is assuming they were when i never said they were and never claimed they were in the advert.

    op?? sorry...i dont have a clue what that means haha may just be my young un intelligent mind hehe

    Well thats what i thought, when i bought the bike...it was sold as running, i started the bike and ran it...seemed fine, 2 days later...the bike wouldnt start...spent a small fortune fixing the bike and was running fine...wanted a larger bike so hence why i advertised the bike to fund the new bike...still wondering whether he will appear tonight or not:j

    Regardless of anything else, if he had a problem with the bike he should have contacted you before doing any work on the bike. As "his friend stripped the bike down" you can tell him to foxtrot oscar, he bought it, failed to test it, end of.

    Makes no difference.

    If you were honest then that's you covered. He has to prove you sold him a faulty machine now and that you knew about the fault.
    As long as you have been honest you are ok. "Sold as seen" doesn't cover lying on the part of the seller.

    this is what everyone seems to be telling me, i.e friends & family...i dont understand why anyone in their right mind wouldnt test a vehicle before purchasing it...totally bewilders me....he hasnt text me back since yesterday when i told him i was not refunding any of his money as the bike was sold and his friend had stripped parts of it down to find the problem....just wondering whether he will appear tonight regardless, might have to call the police or get the dog to the door haha
