I stand corrected :( thanks, guys.

The number of nights was only included as a cravat, I still stand by my statement that the documentation clearly states 'living together as a couple' which it appears you are not.

I think your vocabulary is somewhat tied up!

Do you mean caveat? (as in caveat emptor - buyer beware?) ;)

Anyways, number of nights? What about a serving soldier in Iraq for the next 6 months? Oil rig workers posted for 3 months at a time?

Even some people who choose to live apart but remain a couple (married usually) for all sorts of reasons.

I'd say as soon as you said Partner, you probably gave the game away.

My partner and i live in seperate houses but spend as much time as possible together, I live close to my elderly parents and my work, and it is an arrangemnt that suits both our needs, my incomes has dropped sharply in recent months ( i am self employed) and i am probably eligible for working tax credits but do we count as a couple as my partners income is a lot more than mine, thanking you in advance :)

Although there's a lot of good advice on these forums I'd say when it comes to matters like this, that could lead you into trouble, go straight to the HMRC and ask them, only they can tell you the right answer. Good luck :)
