You have NO "rights" other than those inferred by normal consumer Law. You have, in effect, paid by cash.
If you pay on your debit card and the firm "fails" - your (debit) card issuer is under no legal obligation to help you (unlike a credit card issuer). You can however put your name down with all the other "ordinary" creditors - but you come well down the list behind people like HMRC.0 -

I posted the following somewhere else on the forums, I take it I have no chance of using the visa debit chargeback scheme and should just approach the administrators?

Recently ordered a PC from Mesh (I know, I know ) and paid by visa debit card.
They havent delivered it and its been 20 days since ordered. I had a call from the person that took my order explaining because the company was under they cancelled my order and said I would have to contact the administrators.
If I had paid by credit card I would go down the usual route but can I use the visa debit chargeback scheme in this situation?

Just had this email from Mesh:
" I would like to take this opportunity to apologise for any delays you have sustained with your order. After a thorough review, the decision has been made to place Mesh Computers Ltd into administration. Therefore as of the 31st May 2011, Mesh Computers Ltd cease to trade.
We would like to offer our sincere apologises for the inconvenience this has caused.
If you have made a payment via credit card for goods due to be delivered by Mesh Computers and these goods have not been received, then you should contact your credit card provider immediately to discuss the possibility of a refund. Under section 75 of the Consumer Credit Act 1974, you may be entitled to claim a refund for purchases between £100 and £30,000.
If you are unable to claim a refund via credit card please contact the Administrators Paul Michael Davis and Adrian Paul Dante. The address is MacIntyre Hudson, New Bridge Street House, 30-34 New Bridge Street, London, EC4V 6BJ. Once you have contacted the administrators they will be able to forward you a proof of debt form which should be completed and sent back to them immediately.

I contacted my bank on Tuesday and initiated the Visa Debit Chargeback process, I'm waiting for forms to fill in and return to them.
Is there any point in doing this now or should I just contact the administrators and hope for the best?
Oh, another thing, the only reason I paid by debit card was because when I tried paying using my credit card (over the phone) Mesh's system wouldn't accept it (no problems with the crad, limit, details etc. - they said it wouldn't work) so I had to pay by debit card which went through fine. I feel like I've been set up

I'm going to HSBC today to enquire about the visa debit chargeback and if it will actually work. I'll update the thread once I know more.
Personally I think it will have to go through MacIntyre Hudson.0 -
Well I spoke to HSBC who advised they would send a letter out which I need to fill in and any other documentation to help my case (all I have is an email from mesh confirming the order and also a letter from administrators saying they wont be paying me back).
They couldnt say if there was any chance in getting the cash back so I just need to wait.

Well, checked my bank account this morning and HSBC have refunded the money I paid to Mesh. About 5 days after I posted everything off to them.
Those of you who have paid by Visa Debit I would strongly recommend the Visa ChargeBack route through your bank

I ordered a PC from Mesh on 11th April. It arrived late, and not working. It was returned and I was promised my money back (Distance Selling Regulations). Instead, a few weeks later, they returned the defunct PC to me. After lots of phone calls and email correspondence (mostly from my side as Mesh seem not to believe in replying), I've had lots of promises for a refund - none fulfilled.
I've started a Section 75 action against them... Mesh promised my credit card company that they would email them. Of course, Mesh didn't email back.
My credit card company called them again, and was assured that the money would be refunded within 7 days. The credit card company called me to ask it that was OK. I said, "no I see no reason to believe them now" and the credit card company agreed recharging the money today. Apparently Mesh have the right to challenge a recharge within 45 days. I think the only grounds that they might have would be if they have refunded me before the recharge is processed.
