Buyer hasn't paid postage

If he doesn't pay within 4 days file a NPB with ebay and explain they wouldn't pay postage
if they paid and you refunded you wont be able to file a NPB. this has happened to me in the last few days where a buyer paid but the email he used was fake, so i refunded the paypal account as 9/10 he would have used a stolen PP account, since then the buyer has made no contact with me so when i went to make a NPB against them i got the message that their records show i refunded so a NPB cannot be made and all ebay say is use the cancel transaction link to get the FVF back if the buyer agrees.
i have told them no as the buyer has used a fake email and stolen pp account so i am legally entitled to all fees refunded.0 -
