Wrong item dispute - but I organised courier

I missed the fact the op had a claim already. However it is not fraud to open an INR if you haven't received the item you ordered.0 -
OP are they a business a seller or private? Just seen it's 2nd hand, so I assume a personal seller.0

Yep that was my first thought at least that way you only lose one lot of courier fee's. OP has already started a SNAD though I believe?0 -
I've now emailed ebay to see how they may view the courier fee in this case if the complaint is escalated. I spoke to a lady on the phone too who said I may have a case. If not, I will have to relist the item on ebay and try to recoup some of my money. What makes me seethe is then the seller will get away with it and I will probably lose money. And if I leave negative feedback, they'll leave it back and spoil my 100%!

OP - It is not a small amount you ar talking about - Send them an email explaining your grievance and state that you wish to recover the cost of the item and associated expenses and are prepared to take them to court if need be. Follow this up with a recorded delivery letter stating the same. I think there are some examples of letters you can use on the forum (or you can get a sample letter from CAB or the net). I think you can complete the forms for the small claims court and send them a copy without actually filing it (and paying!). It may be enough to scare them into action if they think you are going to be claiming more than they were paid for the item.0
