Orange not honouring contract?

Hi, I have to find out if I am right before I start running my mouth at Orange and/or Carphone Warehouse......

A few months ago I was offered the standard phone upgrades from Orange when my contract was coming to an end.
I found the offers to be unsatisfactory, so went into Carphone Warehouse and spoke to their staff.
They arranged a better upgrade, still with Orange, and I got the phone I wanted without having to pay for it :D
The agreement I signed with Carphone Warehouse had 750MB data usage allowance (among other things), but in the following months Orange have only allocated me 500MB, and are charging me for going over that amount!!!

I am now faced with a rather large phone bill and I simply do not want to pay it!!

I am so annoyed, I would like to cancel the contract and begin a new (cheaper) one elsewhere.

Do I have reasonable grounds for requesting a termination/cancellation of my contract without paying them off??

Please say YES!!!!

Any help would be much appreciated.....:)

We can say yes or we can tell you the truth. :)

Different Orange plans come with different internet allowances, Dolphon 10 has 100 MB but cost s a tenner a month, Dolphin 45 cost £45 but comes with 500 MB, Panther oplans come with 500 to 750 MB allowance depending on the plan.

Other plans don't have internet but you can add it on for extra.

What plan do you have, it may be it's not been set up right, it may be that you were mis informed by the salesman in which case you'd have a case against CPW, but with all oral deals unless you can prove it you'd be hard pushed to get anywhere.

If it's written down even better..

    You signed it.
CPW signed it on behalf of Orange.
You have a proof. Show it to Orange and demand the limit to be increased and all the charges refunded.
    As simple as that.

If you don't have a proof, request a copy of the contract you signed.

Only if Orange refuse to honour the contract you can demand cancellation.

You'd have to speak to CPW, Orange will only apply what CPW tell them to, get CPW to confirm they offered you 750mb, they should then speak to Orange, Orange would rather up the limit than face losing a customer

If CPW wrote on the contract that you get one million trillion gigabytes of data each month, would you expect Orange to honour it?

No. It's clearly CPW's error here. Not only do they do the upgrades themselves on the system, but they also select the tariffs. So either they selected the wrong plan or they misadvised you.

It is up to CPW to put this right, not Orange, as they are authourised agents of Orange, so the buck stops with them.

Yes. I would expect CPW to ensure that the contract they agreed was delivered.
Whilst 1 million trillion gig might be a clear pricing error, the difference between 500mb and 750mb is not in the same scale, therefore the "error" element is removed.

In reality it has nothing to do with orange. The contract was made with CPW.
If CPW have to take a commission hit on the deal, so be it.

I had a similar experience with phones4u and Orange - contacted phones4u, got it sorted.
  • Thanks guys, MASSIVE help!!!!
  • If I go see CPW asking for a copy of the agreement I signed with them, they have to do so, right?

If CPW are authorised agents of Orange, and CPW is who I signed the contract with, then surely it becomes null and void with CPW, and therefore Orange too??

Why does it become null and void?
