Company refusing to refund delivery charge

There really is not need for a racist comment like that. I can point to hundreds of non-Asian businesses who try the same flipping thing. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0

I know...But there really is a problem within Asian communities, such as East-London, areas across the midlands, etc... in terms of education around consumer rights and such, and management to many Asian based companies don't understand SoGA and DSR... Go to a saree shop and you'll see "NO REFUNDS" written in hindi often...
Oh also, I imagine the OP would agree with me when I say...Rupali is amongst the 'top class' stores/brands of Asian clothing in the UK...Such behaviour should not be expected from them0 -
I'm not surprised ONE BIT!!! I turned to NDTV Imagine the other day and saw those ridiculous TV ads for those crappy exercise machines - the ad probably breaches 100 different ASA rules ... Then it blatantly said at the bottom of the screen "7 DAY MONEY BACK GUARANTEE MINUS P&P COSTS"
These Asian companies don't seem to understand DSR...I can say this, because I am Asian, so no, it's not racist! There really is not need for a racist comment like that. I can point to hundreds of non-Asian businesses who try the same flipping thing.
Its not racism, its generalisation!0 -
On the back of this thread I emailed Marks and Spencer and this is their reply:-
Thank you for your email about the delivery charge refund for the trousers and top you returned.
If items are returned within 7 days of receipt you are entitled to a refund of the delivery charge. If the return is outside this period the delivery charge is not refunded.
If we can be of any further assistance, please visit our help page at: http://help.marksandspencer.com or via a web enabled mobile. Alternatively, you can call us on 0845 609 0200 or +44 113 866 3017 if you’re calling from overseas.

Which, if I am not mistaken clearly contravenes the DSR rules quoted on page 25 of the earlier link. I will be pursuing the matter with them.0 -
Not necessarily.
The DSRs mean you can return within 7 days and be reimbursed your original postage costs, anything beyond 7 days is down to their store policies and goodwill so if you return outside of your statutory 7 days I fail to see why they are legally obligued to refund postage............0 -
Not quite. The DSRs allow for the buyer to cancel the contract within 7 days, they do not have to actually return the item within this period, so strictly speaking M&S are indeed contravening the DSRs with that condition. Not necessarily.

And don't forget those seven days are seven working days starting on the day after delivery.
Where working days does not include Saturdays, Sundays or public holidays.0 -

This problem is not confined to any racial business community. To suggest so is abhorrent. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -
A lot of companies out their are set up and the owners/staff are not aware of SOGA or DSR and think that whatever their policies state are correct and legal. even large companies thing that they are above the law0
