Mis Sold Airline Ticket

Hi there all, I'm really hoping someone can help me.
I'm heading back to the UK later this year and booked a flight through Opodo that would allow me to change the dates. I checked the terms and conditions very carefully and rang up Opodo to clarify that I could change to a date later this year. I did not want to leave anything to change
I plan to fly back December and just called up to change my flight dates, and was told that the airline doesn't service my route in the winter.
I feel I have been mis-sold as it did not say this in the terms and conditions, and I was advised I could change 11 months from the ticket date.
Does anyone know what my rights are here?

Any airline can choose to withdraw from a route, whether for a season or for good. Air Berlin is a low cost carrier, the type most likely to chop and change routes and times, having said that they have a very good reputation for timekeeping and service. An agent cannot possibly know what an airline is going to do 5 months down the line, but you should be offered a refund for the unused portion, my only question is why you would ever book an Air Berlin flight on anything other than Air Berlins own website since Opodo will have charged you a service fee for the booking.0

Yes - I am starting to regret this. I booked with them as they had significantly cheaper charges for changing the dates.
I agree that routes change, but at the time Air Berlin would have known this was a summer route and had not put this in the terms and conditions. It said I can change up to 11 months.
Opodo have initially said that changing flights is subject to availability and it is not possible to issue a refund. I have asked them to go back and review, as I see this as a route being pulled and that I have been mis-sold.
What is my route of legal action should they not issue a refund? I could start with my visa card, or is there a more formal route?

I don't really see this as miss-sold. More like bad luck or timing.Theres probably 100s of flights you could take to full fill the contract You could maybe fly out in July, August Sept , return April , May June for instance, all would be in the 11 month window.
I agree with Alan. Possibly a refund of unused portion.

They may have known it was a summer only route but they have no idea when you may want to fly. At the time of booking did you check the airlines schedule for the dates you thought you might want to fly on?IT Consultant in the utilities industry specialising in the retail electricity market.

Yes always the finer details! I couldn't check with the airlines as at the time they did not have the dates published for the months I was changing to. It was to early.
So I checked with Opodo and they stated anytime within the next 11 months. I actually stated I might need to change to the winter months.
So I feel it is not the product I was sold and advised on isn't what I was told it would be, it this isn't mis - sold, then what is?0
