If the CMC goes to court, they will have to prove that they did not get the business by cold calling. If they did use cold calling to take on the case then their solicitor would be in breach of the SRA code of practice and so the court case wouldn't even begin.

When I called the MOJ about being cold called they told me that I had perhaps signed something some time ago to allow my data to be passed about. I told them I doubt I had and they had no interest other than to say I would have to prove cold calling as if I had signed something it was not classed as a cold call. What about the reminding firms to look into the complaints properly in the first place so no need for complaints to go to FOS in the first place. Half the complaints that go to FOS are blatent missales and the firms need BIG fines imposed for allowing this. Why should someone that is missold have to wait another year or two for a redress? Often the redress would help with other debts that they are paying far more than 8% interest on. They often know this and that could be their reason!!!What about reminding people to go to FOS and I agree avoid using CMC's.0 -
Are the banks actually obliqued to reopen complaints that they already rejected prior to the JR of their own violation?
No they are not. The JR had nothing to do with complaints already looked at and upheld or rejected.I am an Independent Financial Adviser (IFA). I didnt think it was a good slot at all.
Martin was rushed into a very tight segment and was cut off after only answering a couple of questions. Its the first time I have watched Watchdog in ages and I thought it was dire. If they got rid of the braindead fluff they could get so much more important detail in there.
I also disagreed with Martin's comments on claims companies using the legal system rather than the FOS. Claims companies are not allowed to cold call if there is the potential for legal action. The vast majority of claims companies never go near a solicitor and just use the FOS. There are some which may look at the legal route but they are rare.

You can complain about any loan regardless but if he meant about taking the complaint to FOS if it was not upheld then this is misleading. If it was taken out with an unregulated broker and its still running now then you could not go to FOS if they fail to uphold.
As regards CMC's then there must be some that are "good" claims companies amongst them. Its only the same as finance firms, look at FOS statistics on complaints, there are hardly any firms that don't get complaints against them so what are we supposed to do there. If we need to invest money where are we supposed to go? Are we supposed to put it under the matress as its safer that way because banks cannot be trusted.0
