Retailer saying "out of stock" instead of selling my goods at a reduced price

A retailer had the incorrect selling price for an in stock item when I went through the checkout but a couple of hours later and they are now saying its "Not available".

I was looking for an external HD this morning and found a company selling a 320Gb USB HD for £4.99 (originally over £100). The order went through fine but now I have an email from them saying "The following item on your order is not available with our suppliers any more"

Its obvious what they are doing but do I have any right to ask for it at that price?

No you don't. The contract is not formed until they send the goods out, and can withdraw from the sale at any point up to then.
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

Whether it was in stock or not, you already knew it was incorrect - therefore its luck of the draw, they are under no obligation to fulfill the sale.

Yes and they have a right to say no.

  • In addition there is no way a 320Gb external drive was over 100 quid, half that at the most!
  • ...and they were never "your" goods (OP). They are privately owned by the company that you offered to purchase them from.

    They rejected your offer.

It sounds like the 320gb Toshiba one doing the rounds at the moment. If the incorrect price was £4.99 then the correct price was likely £49.99 so a decimal point was to blame.
