Ebay item not as described, where do I stand?

Thank you, I shall wait for a reply, I'm surprised I haven't had one - well I'm not obviously - but all the other big sellers I've used have always been very good at responding quickly and usually if there is a damaged item as long as I have photographic evidence just sending out a new one.
And that's really why I'm annoyed, this isn't a case of the product being faulty or damaged in transit, the seller has clearly been selling used products are new - and they must know they are. The product is faulty/damaged, but due to prior use not manufacturing faults etc.
I dunno what to do really - even though it is only £6, it was MY £6. And I'm not the sort of person who like to just let things like this go.
The problem is when I sent the message it says I'd have a reply within 1 - 2 days, but if I don't get one and then have to send second, that's another 1 - 2 days, and obviously the longer its unresolved the less likely it will be to get resolved.0 -

Well reply from seller seems positive. They say they will send out a new item along with a prepaid envelope to return the other one. - Maybe this was an honest mistake, I guess if their "new" stock was acquired as unsold stock from another supplier who through in a returned item - but the fact the item included a new set of batteries plus those within it is a bit peculiar.
If they do then I really can't complain.0 -
