Stock of bulk LPG mine???

Hi – I’ve recently bought a little business and the property is on bulk LPG for the heating. The tank is BP, and I'm in the midst of getting quotes from various potential suppliers.

BP are telling me the content of the tank (85% full) is theirs, and the previous people / company never paid the bill for it.

The property has been empty for over 3 years, and the previous owners did a bunk, so I can imagine BP never got paid (like many others it would appear!!). There was nothing mentioned about ‘stock of fuel’ in the inventory from the motgagees in posession when I bought it. I was under the impression that any fuel in the tank would be mine, and if I stay with BP I would / could use the fuel, or if I go elsewhere whoever I get a new tank from will simply pump the old stock into their new tank for me. Does anyone know if BP have a leg to stand on to claim title to the gas? surely they should have took it back at some time in the last 3yrs if they didnt get paid for it. They had came out at some point in the last 3 years and took off the 1st stage regulator but all the fuel is still in it. Given the cost of LPG there's a few quids worth in there, so would be agrieved to loose it if BP are just trying their luck! Any advice would be great. Thx

    I'm no lawyer but as far as I am aware they get 5 years to chase the previous owners in small claims court for either the money or the right to take the goods back.

    how do they know that it hasnt just leaked out :D

    no but i think if they didnt pay the bill and nothing was said re the tank what you bought it i think they would try to bill you for the gas as its never been payed for and if they own the tank there isnt a lot you can do as we are thinking about bulk tank ect and the terms and conditions for them get you every way eg we own the tank
    we own the gas till paid for in full ect ect i would have a look at the legal pack for the house re the contract for the bulk gas tank and the supplier and see what it says if you get my drift good luck:D
