Advice needed - problems with second hand car

    Not at all, it is a gear box failure likely a bearing failure, a bearing which can easily be shown to have been working when they bought the car working because they drove it away and drove it for 2 months - then it broke

    This is exactly the same as happened to Thain in Thain vs Anniesland, but Thain had hers break after 2 weeks.... The court ruled that the car was of satisfactory quality at the time of the sale because it could be driven away.

    Used cars (esp ones of a ripe age/mileage) are reasonably expected to have items that will or could fail at any time and are thus satisfactory.

    A huge number of cheap Puntos have been driven into the ground and thrashed by owners that have no intention of ever servicing or maintaining them in anyway.

    This makes them a bit of a handgrenade used buy.

    You can be lucky and get a well maintained one and you can have no problems, or you can buy a wrong-un and feel the pain.

    I've had 2 (present one an HGT), never any probs. Temp gauge is lower on motorways and never ventures over the half way mark anyway. Everything still works on it and the only major expence was a cam belt change a few months ago. Brilliant little cars. The new one; Punto Mylife must be one of the best value cars in its class at under £10k when you compare it to cars like Smart Car ect.

    I just realised the gearbox failed 3 months ago and the OP must have paid for the repair, the old gearbox presumably now lost, there is no evidence anyway. This would be thrown out of court.

    The recent exhaust failure is normal wear and tear and to be expected on an old car.

    No case to answer. You have no recourse and all you can do is fix the problem and hope nothing else goes wrong with it for another year.

    Actually I've just noticed that as well (after you pointed it out!). Yep, the OP has shot himself in the foot then unless he can prove he gave the seller an opportunity to investigate AND prove the seller refused.
