    Old enough to take responsibility for my own actions and to know know that ordering a pizza isn't the same thing as dialling a premium rate number. Why?

    Man this is a strange sinario: a burglar ordering a pizza? so you come home, find everything gone but hey, they ordered to a pizza to soften the blow..? Or maybe too it with him, leaving their ID with the pizza delivery man and their voice on their systems just to aid the police in finding them... TBH I'd assume the insurance would take over this, the fact it was a police matter would probably make the pizza company back off (so lose money) I think it'd be a brave company to start hounding the original occupier to pay up- though most pizza delivery companies expect payment on arrival, if you didn't order it, it was a hoax caller and again, the company foot the bill, seen it happen before in the block I live (kids with small lives, adults who drop responsibility).

    When it comes to mobiles its slightly more cut-throat, they don't seem to take into consideration anything prior to the exact time you called up to report the phone as stolen. In this case it would probably take some sort of common-sense based small claims court to get them to look at the situation with human eyes and not automated system eyes. That and having to grovel (even though you shouldn't have to) mobile companies bend the rules to suit themselves, this is the general rule apply it to any slightly complex situation, disregard law, common sense and sense of humanity and you have the answer to most mobile company problems IMHO.

    here's the scenario:

    mobile and fixed line phones are covered by the exact same Criminal/Consumer Laws and Regulations....so

    1/ if a burglar breaks into your house and orders a pizza using your fixed line phone.........are you liable under those Laws and Regulations to pay for that pizza?

    2/ the same burglar breaks into your home and orders a premium sms (eg joke) using your mobile.......are you liable under those same Laws and Regulations to pay for that sms?

    in whose interest does it serve for the public to believe they are?

    1/, Interesting Question, I'd say it depends on the company you order from, With some companies it might state in the T&C's somewhere that by ordering from them you are entering an agreement to purchases and pay for the goods once the order has been made etc etc, Although you'd have to research under the Sales of Goods act....

    2/, I'd be more worried about getting the burglar locked up to be honest lol, But again, i'd imagine by texting the company you are entering an agreement under the 'Sales of goods act' etc.

    End of the day, Someone has to pay somewhere along the line.
