Seriously I can't see anybody being dismissed for checking their email, we were only talking about email mind not doggy websites (which I wouldn't recommend)

That is a pretty naive statement, what excuse did they use the last time they sacked you? :rotfl:

As Richie went on to explain, if redundancies are coming up or your employer wants you out the door but has no justifiable reason to dismiss you they will pounce on any scrap of misconduct they can find...exploiting company equipment would be sufficient in many cases.

As for 'we are only talking about email...' how do you think most viruses find their way into company networks? When people check their personal emails and try to circumvent network security to do so. That funny (if not a little racist) email that Sue sent to you and a dozen other friends just happens to contain some malicious code...now it is spreading across the network, time to get onto the job centre? :T

There are very strict rules regarding employment contracts relating to "other documents" i.e. Employee handbook. The existence of these other documents MUST be highlighted to the employee and MUST be available to view, most employers will issue a HAndbook with the contract just to be safe.

If they have an IT policy, it is usualy included in the employment contract or Handbook but anything regarded as gross misconduct must be highlighted within these documents (usually with a generic statement of doing anything that would be detrimental to the Company) but I would say that if there are specific restrictions on using the Internet then this should have been told to the employee at the point of issue of the access code.

I have never been sacked, only resigned (and restrictive internet policies at work contributed to that it really winds me up) but that's not the point.
IF the circumstances are as you say, sure be very careful.
But if everything is going fine, no redundancies, no reason to assume they want you out would they sack you without so much as a warning? Surely half the country should be sacked on the spot today!

thanks everyone for replies. the thing is we have a manager who is our line manager he works in the house, but the proprietors have asked everyone to refrain from bringing laptops in. this was said because it was being abused by a staff member who was on it all day! thankfully they no longer work here now but my line manager has said he personally doesnt have a problem with it. He knows i use it in my off time, im just worried about the proprietor side of it

    if that makes any sense
Even a stopped clock tells the right time twice a day, and for once I'm inclined to believe Withnail is right. We are indeed drifting into the arena of the unwell.

In that case ask for a variance, simply put ask you line manager to send you personally an internal memo dated and signed to that effect .. .. no problem. That way you become a fully paid up member of the PTA.

As yhou are using your own laptop make sure the security is to to scratch, you wouldn't want to get anything nasty from the work network
It's taken me years of experience to get this cynical
